PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY THE INVOCATION GIVEN BY ALDERMAN GENE DANNER. Mayor Crouch asked for roll call at 6:30 P.M. Present. Aldermen Kovachevich, Williams, Mazza, Selfridge, Carl , Grant, Danner, Motsinger, Churchill . Absent. Alderman Horr, Clarke. MINUTES OF JUNE 17TH MEETING. Motion by Alderman Danner, second by Alderman Churchill , the minutes of June 17th meeting be accepted and placed on file. Voice vote, motion carried. COMMITTEE REPORTS. Public Works & Buildings. Council Action. None. Legal & Ordinance Council Action. None. Public Safety & Protection. Council Action. Motion by Alderman Churchill , second by Alderman Kovachevich, to accept the bid of Buckheart Fire District for the sale of used fire hose in the amount of $645.00. Roll call . AYES: Aldermen Churchill , Motsinger, Danner, Grant, Carl , Selfridge, Mazza, Williams, Kovachevich. NAYS: None. Motion carried. 9 ayes 0 nays 2 absent. PUBLIC HEARING - PROPOSED USE FOR REVENUE SHARING ENTITLEMENT PERIOD #11 7:00 P.M. Purpose for the public hearing is as follows: Proposed use of Available Revenue Sharing funds, Entitlement Period 11 , $85,302.00, plus obligated funds not used in the amount of $8,500.00, and interest earned in the amount of $33,000.00 (Total $126,802.00) . The public is invited to give oral or written comments and suggestions in regard to the use of these funds. Recess council at 7:00 P.M. to reconvened in Public Hearing. GENERAL PUBLIC: Joe Menne 519 E. Ash St. Monies should be used on the basic City services, such as fire, police, streets, garbage. Do not use it on additional parking lots. Mayor Crouch adjourned the Public Hearing at 7:04 P.M. and reconvened the Council meeting. LOCAL #1897 - GRIEVANCE 80-107 (HOERMAN) . The grievance states-worked a volunteer Fire Fighter without asking a regular fire fighter on May 31st, 1980. Violation of 16.2 of Fire Department contract. The contract, section 16.2 reads-recognizing that the Fire Chief may, from time to time utilize trained volunteers for general duties they shall be bound by the same code of ethics and responsibilities as a regular employee. Volunteers shall only be used for regular duty when the vacancy they fill exceeds three (3) full work shifts. Mayor Crouch's response-it is therefore my judgement that there is no merit in this grievance as it was well known that a vacancy would exist for at least three work shifts on May 7th and had in fact existed for eight work shifts at the time the volunteer was used. This grieving firefighter would not have standing even if the three work shifts had been violated, as he would not have been the first avail- able for call . 31 Continued July lst, 1980 Fire Chief Grier' s comments-According to my interpretation of Section 16.2 of the current contract regarding utilization of trained volunteers, it seems very clear that no violation exists due to the fact that three full work shifts did exist before a volunteer was utilized. Howard Dye was on vacation beginning May 4th thru May 26th 1980 when a leave of absence granted him began without interrup- tion of the vacancy. Motion by Alderman Mazza, second by Alderman Danner, the appeal be denied and the findings of the Mayor and the Fire Chief be upheld. Discussion. Voice vote, motion carried. 2 nays heard. LOCAL #1897 - GRIEVANCE 80-108 (-BURNHAM) . Mayor Crouch stated that it i.s basically the same question. Motion by Alderman Williams, second by Alderman Kovachevich, the grievance be found valid. Discussion. The difference of these two grievances is that Hoerman was 8th on the call list, and Burnham was 14th. Voice vote, motion defeated. 5 nays heard. Alderman Churchill left Council Chambers at 7:00 P.M. by prior request. I� MAYOR'S REPORT. (� Police Reserve Appointments. Dave Vandemeer, Karen Korth, Kirby Hackett, Frank Q Huff, Judy Iwashita, Dick Fairburn, Nancy Wilson. Motion by Alderman Williams, Q second by Alderman Selfridge, the appointments be confirmed. Discussion. Mayor Crouch reported that these appointments were made by Chief Story and Bob Groves Director of the Police Reserve. This now brings the Police Reserve Unit to its tmtal strength of 24 members. Voice vote, motion carried. Appointment to the Library Board of Nancy Andrews. Motion by Alderman Williams, second by Alderman Kovachevich, the appointment be confirmed. Voice vote, motion carried. She is replacing C. Danny Moore. Mayor Crouch stated that he and the City Attorney have been working on finding someone to purchase Tax Increment Bonds ever since we received a favorable ruling from the supreme court. They have been successful , and the rate will be around 8%, and somewhere around $900,000.00 in bonds to be sold. Mayor Crouch is recommending that the City Attorney be instructed to draft an ordinance approvi.ng the issuance of a bond issue to be determine what the Tax Inc- rement amount will support. Motion by Alderman Danner, second by Alderman Self- ridge, to concur with this recommendation. Discussion. Voice vote, motion carried. Motion by Alderman Williams, second by Alderman Kovachevich, that a member of the Fire Department be allowed to address the Council . Discussion. Roll call . AYES: Aldermen Kovachevich, Williams, Carl , Grant. NAYS: Aldermen Mazza, Selfridge, Danner, Motsinger. 4 ayes 4 nays. Mayor Crouch voted nay. 4 ayes 5 nays 3 absent. Motion defeated. OLD BUSINESS: ORDINANCE - AMENDING TITLE 2, CHAPTER 1 CONCERNING THE FIRE & POLICE COMMISSION. Second reading, read by title only. This ordinance was tabled from the last Council meeting to a time certain of July lst, 1980. Motion by Alderman Danner, second by Alderman Motsinger, the ordinance be placed on its passage. Roll call . AYES: Aldermen Motsinger, Danner, Grant, Carl , Selfridge, Mazza, Kovachevich. NAYS: Alderman Williams. 7 ayes 1 nay 3 absent. Ordinance being # 826. ORDINANCE - PROHIBITING PARKING ON E. MAPLE ST. BETWEEN S. FOURTH AVENUE AND S. FIFTH AVENUE. Second reading, read by title only. Motion by Alderman Kovachevich, second by Alderman Carl , the ordinance be placed on its passage. Roll call . AYES: Aldermen Kovachevich, Williams, Mazza, Selfridge, Carl , Grant, Danner, Motsinger. NAYS: None. Motion carried. 8 ayes 0 nays 3 absent. Ordinance being # 827. 32 Continued July lst, 1980 ORDINANCE - VACATING AN ALLEY IN B. H. TAYLOR'S 2ND ADDITION. Second reading, read by title only. The City Attorney stated this requires nine affirmative votes and nine council members are not present. Motion by Alderman Motsinger, second by Alderman Carl , the ordinance be laid over to the next meeting. Voice vote, motion carried. ORDINANCE - VACATING A PART OF ALLEY G. Second reading, read by title only. Motion by Alderman Carl , second by Alderman Grant the ordinance be laid over to the next Council meeting. Voice vote, motion carried. (Nine affirmatives votes) . NEW BUSINESS: BIDS - STREET SWEEPER. Motion by Alderman Grant, second by Alderman Carl the City Clerk be instructed to open the bids. Voice vote, motion carried. Roland Machinery bid $41 ,895.00 trade-in of $2,00.00 total bid being $39,895.00. Truck Equipment bid of $44,476.00 trade-in of $2,500.00 total bid being $41 ,976.00. Motion by Alderman Carl , second by Alderman Williams, the bids be referred to Street & Traffic Committee and the City Engineer for their review and report back to Council . Voice vote, motion carried. AGREEMENT —DEPT OF TRANSPORTATION AMENDMENT FOR MALNTENANCE OF STREETS. Read by title only. Motion by Alderman Williams, second by Alderman Motsinger this agree- ment be referred to Street & Traffic Committee and the City Engineer for review and report back to Council . Voice vote, motion carried. AGREEMENT - CONTRACT FROM VILLAGE OF NORRIS WATER PURCHASE. First reading, read by title only. Discussion. Motion by Alderman Danner, second by Alderman Grant, the agreement be amended under section A. 1 . at the conclusion of that paragraph, for useage by consumer of the purchaser residing within the corporate limits of the purchaser. Discussion. Voice vote, motion carried. Motion by Alderman Danner, second by Alderman Kovachevich, the City enter into this amended agreement with the City of Norris. Roll call . AYES: Aldermen Motsinger, Danner, Grant, Carl , Selfridge, Mazza, Williams , Kovachevich. NAYS : None. 8 ayes 0 nays 3 absent. Motion carried. Agreement being # 370. ORDINANCE - ANNUAL APPROPRIATION. First reading, read by title only. Discussion. PRE-ANNEXATION AGREEMENT -FRANCIS AND MAUREEN MAllA. First reading, read by title only. Alderman Mazza requested to be excused from voting on this agreement and from taking part in the discussion. Motion by Alderman Selfridge, second by Alderman Carl , the City enter into this agreement. Voice vote, motion carried. Agreement being # 38V. Alderman Williams asked about the City of Canton being sued. Mayor Crouch reported that Fulton Square has paid the Douglas Corporation for the project they constructed. Thd City was brought into the suit because the City owns some of the property that is involved. ORDINANCE - AMENDING TITLE 6, CHAPTER 1 , SECTION 2CONCERNING THE CHIEF OF POLICE AND REPEALING TITLE 5, CHAPTER 1 . First reading, read by title only. Discussion.
