HomeMy WebLinkAbout05-22-2015 Liquor Commission Hearing City of Canton Liquor Control Commission Meeting May 22, 2015 3:00 p.m. City Hall Director's Room 2 North Main Street Canton IL 61520 IN ATTENDANCE: Mayor Jeffrey Fritz, Attorney, Commissioner Mike Freeman, Commissioner Doug Manock, Attorney Representing CSK Ventures Inc (Sam Zabek), CSK Ventures Inc owner (Ted Arndt), Tonya Simpson, Landlord (Joe Abraham), Landord ( Abraham), Canton Police Department Detective Gerald Foreman, Canton Police Department Detective Joshua Wages, City Attorney Nancy Rabel, City Clerk Diana Pavley-Rock DISCUSS, CONSIDER AND VOTE ON PUNISHMENT FOR ALLEGATIONS AGAINST CSK VENTURES, INC D/B/A SOUTHERN BAR&GRILL Attorney for CSK Ventures said the notice was sent out May 18, 2015 and he did not have enough time to meet with his client regarding the hearing. The attorney asked for a continuance since he did not have adequate time to prepare for the revocation hearing. Attorney Rabel said she would object to his request. The original notice was sent out for a hearing to be held on May 18, 2015. Tonya Simpson appeared at that meeting and it was agreed upon at that time to continue the hearing to May 22, 2015. Ted Arndt was not able to attend the meeting on May 18, 2015 due to a medical emergency. The original notice was returned signed to the City on May 14, 2015. The Attorney for CSK Ventures said he was just informed and did not have enough time to prepare for the hearing. Attorney Rabel said this was the second notice and was a continuance from the hearing that Ted Arndt did not attend. The original notice was sent out with the required three day notice. Attorney Rabel's request is to have the liquor commission have a temporary suspension of liquor sales until the actual hearing be reschedule. The attorney for CSK Ventures said he would object to any suspension. Any suspension would be immediately appealed to the Illinois Liquor Commission. The attorney for CSK Ventures asked the commission for just enough time to prepare for the hearing. He would have enough time to contact witness and gather evidence. Attorney Rabel said she would like to have the records clearly state that the original notice was sent out May 12, 2015. It was received and signed on May 13, 2015. Connie Alexander signed for the first one. The attorney said the registered agent was not served. Attorney Rabel said she would still stand on the request of a temporary suspension of liquor sales based on the allegations until the next hearing is rescheduled. Mayor Fritz said the notice was issued within the time limits of the statute. A representative of CSK Ventures Inc showed up at the first meeting and explained that Ted Arndt could not be at the meeting. The Mayor said he actually asked for the input of the representative for rescheduling the next hearing. Today's date was agreed upon. Mayor Fritz said he is not sure why CSK Ventures did not notify their own attorney about the hearing. The attorney for CSK Ventures Inc said he is not sure that property service was issued since the agent was not served. Attorney Rabel said it is within the liquor commissions statutory rights to suspend the sale of liquor without a hearing. She further stated that she wouldn't object to a continuance if they would suspend the sale of liquor until the hearing. Considering the allegations it could be detrimental to the City. The Attorney for CSK Ventures suggested having restrictions put into place between now and the rescheduled hearing. The restrictions would set guidelines on who could serve and sell the alcohol prior to the hearing. If the commission is concerned about who is selling alcohol this would be a good compromise between the two parties until a full hearing takes place. Attorney Rabel said she would not be opposed to this; however Ted Arndt is the only one that has been approved as owner/manager for CSK Ventures. CSK has a valid liquor license with Ted Arndt legally qualified as manager/owner. Motion and second were made by Commissioner Manock/Freeman to continue the hearing for June 11, 2015 at 2:00pm with Ted Arndt listed as the owner/manager selling liquor for CSK Ventures Inc. Roll Call: Commissioner Manock Yes Commissioner Freeman Yes Mayor Fritz Yes The motion carried. ADJOURNMENT Motion and second were made by Commissioner Manock/Freeman to adjourn. The meeting adjourned with no further discussion. Main Street, Canton, Illinois. The purpose of the meeting is to discuss and consider allegations against CSK Ventures, Inc. d/b/a Southern Bar& Grill. By: Jeffrey A.
