HomeMy WebLinkAboutOrdinance #1383`` ORDINANCE NO. ~~~~ AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO JEANNIE S. WEAVER TO CARRY ON A HOME OCCUPATION AT 212 WEST ELM STREET, CANTON, ILLINOIS. WHEREAS, a Petition for Special Use Permit signed by JEANNIE S. WEAVER, the owner of the real property hereinafter described, was filed before the Planning and Zoning Commission of the City of Canton, Illinois, requesting that a special use permit be granted to her to carry on a home occupation for the purpose of practicing hypnotherapy as a certified hypnotherapist; and WHEREAS, the real property which is the subject of this petition is located at 212 West Elm Street, Canton, Illinois and is legally described as follows: Part of Lot 15 in Hulit's Subdivision of French's Addition to the City of Canton commencing at a point 76 feet West of the NE corner of Lot 16, Hulit's Subdivision, thence South 66 feet, more or less, to the North line of Owen Rafferty's property, thence West 56 feet, thence North 66 feet, more or less, thence East 56 feet to the place of beginning; and WHEREAS, JEANNIE S. WEAVER is the owner of record of said real property and there are no other owners of record; and WHEREAS, said real property is wholly situated within the corporate limits of the City of Canton, Illinois and is presently zoned R-3, two family residential district; and WHEREAS, all petitions, documents and other necessary legal requirements are in full compliance with the statutes of the State of Illinois and ordinances of the City of Canton, Illinois; and WHEREAS, a public hearing was held before the Planning and -1- ;.: i Zoning Commission of the City of Canton, Illinois on January 11, 1993, pursuant to proper notice published in the Canton Daily Ledger; and WHEREAS, no objectors appeared at said public hearing before the Planning and Zoning Commission of the City of Canton, Illinois; and WHEREAS, on January 11, 1993, the Planning and Zoning Commission of the City of Canton, Illinois unanimously recommended to the City Council of the City of Canton, Illinois that a special use permit be granted to JEANNIE S. WEAVER to carry on a home occupation for the purpose of practicing hypnotherapy as a certified hypnotherapist; and WHEREAS, it is in the best interests of the City of Canton, Illinois that said special use permit be granted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS: 1. That the City Council finds as facts the recitals hereinabove set forth. 2. That a special use permit be, and the same is hereby, issued to JEANNIE S. WEAVER to carry on a home occupation for the purpose of practicing hypnotherapy as a certified hypnotherapist at 212 West Elm Street, Canton, Illinois, which real property is legally described as follows: Part of Lot 15 in Hulit's Subdivision of French's Addition to the City of Canton commencing at a point 76 feet West of the NE corner of Lot 16, Hulit's Subdivision, thence South 66 feet, more or less, to the North line of Owen Rafferty's property, thence West 56 feet, thence North 66 feet, more or less, thence East 56 feet to the place of beginning; and -2- •• said home occupation shall be carried on exclusively by the inhabitants of the dwelling on the above described real property. 3. That this special use permit shall be personal to JEANNIE S. WEAVER at the above stated address only. Any cessation of such use by JEANNIE S. WEAVER at said adress shall automatically terminate this special use permit. This special use permit is not transferable by JEANNIE S. WEAVER and shall not be valid at any other address. 4. That the records of the City of Canton, Illinois, appropriate documents, maps and related regulations be, and the same are hereby, amended to reflect the foregoing special use permit. 5. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof. PASSED by a majority vote of the City Council of the City of Canton, Fulton County, Illinois and APPROVED by the Mayor thereof at a regular meeting of the City Council on the 2nd day of February 1993, upon a roll call vote as follows: AYES: Aldermen Molleck, Coay, Sarff, Steck, Bohler, Meade, Chaprna~.Z, May.
