AN ORDINANCE AMENDING TITLE 3, CHAPTER 21, SECTIONS 2 AND 3
OF THE CANTON MQNICIPAL CODE RELATING MDNICIPAL IITILITY TA%
WHEREAS, the Canton City Council has determined that
it is necessary and in the best interest of the City of
Canton to amend Title 3, Chapter 21, Sections 2 and 3 of the
Canton Municipal Code as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds the
foregoing recitals to be fact.
2. That Title 3, Chapter 21, Sections 2 and 3 of the
Canton Municipal Code are hereby amended to read as follows:
"3-21-2 (c): Persons engaged in the business of
distributing, supplying, furnishing or selling cable
television service for use or consumption in the City of
Canton, and not for resale, at the rate of five percent (59~)
of the gross receipts therefrom.
3-21-3 (b): No person engaged in the business of
distributing, supplying, furnishing or selling gas,
electricity, or cable television service is subject to
taxation under this chapter for such transactions as are or
may become subject to taxation under the provisions of the
"Municipal Retailers' Occupation Tax Act" authorized by
Section 8-11-1 of the "Illinois Municipal Code formerly (Ch.
24, Sec. 8-11-1, Ill. Rev. Stat., 1989)•"
3. That this Ordinance shall be in full force and
effect immediately upon its passage by the City Council of
the City of Canton, Fulton County, Illinois and approval by
the Mayor thereof.
