Y ORDINANCE NO. 1445 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO RANDY AND BETH HOPPER, d/b/a ONCE UPON A TIME, EXCLUSIVE TO COMMON ADDRESS OF 223 WEST VINE STREET, CANTON, ILLINOIS, FOR THE OPERATION OF A DAYCARE CENTER. WHEREAS, Beth Hopper and Randy Hopper, d/b/a Once Upon A Time, (hereinafter referred to as "Hopper") has petitioned for the issuance of a special use permit personal to Hopper; and, WHEREAS, a public hearing on said request was held on October 10, 1994 before the City of Canton Planning & Zoning Commission which Commission recommended to the City Council the issuance of a special use permit pursuant to Section 3, Chapter 9, Title 10 of the Canton Municipal Code; and, WHEREAS, testimony adduced at the public hearing established that Hopper had been operating a daycare center at said address since the month of August, 1990 under Illinois State License No. 153579-03; that Hopper is a private for profit organization with a current enrollment of approximately 16 children, all of whom are adequately supervised by sufficient staff at Hopper's place of business; and, WHEREAS, all of the subject property at common address of 223 West Vine Street, Canton, Illinois, is presently zoned R-2 residential and the proposed special use is not one prohibited by Municipal Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the City Council hereby finds the foregoing recitals to be fact. 2. That the Canton City Council hereby accepts and approves the recommendation of the City of Canton Planning and Zoning Commission with respect to the proposed use of Once Upon A Time at the common address of 223 West Vine Street, Canton, Illinois. 3. That a special use exception permit issue for Hopper, which special use exception permit shall be personal to Hopper only at the address of 223 West Vine Street, Canton, Illinois and with respect to the following described real property: Lot Number 4 in Keeling Addition to the City of Canton, Fulton County, Illinois pursuant to authority of Section 3, Chapter 9, Title 10 of the Canton Municipal Code. 4. That the special use exception permit hereby c granted for a daycare center shall be subject to the following requirements and conditions: a. That the permit is personal to Hopper and is not assignable to Hopper's successors or assigns. That any attempt to assign or transfer the permit by Hopper shall, by operation of law, immediately void said permit. b. That the permit is subject to the area requirements of subparagraph (F) of Section 2, Chapter 5, Title 10 of the Canton Municipal Code as the same is now promulgated or may hereafter be amended. c. That the permit hereby granted is effective only with respect to the above described real property at common address of 223 West Vine Street, Canton, Illinois. d. That the permit is specifically made subject to all other requirements and conditions of Title 10 of the Canton Municipal Code, as well as all other provisions of the Canton Municipal Code, as the same is now promulgated or may hereafter be amended. e. That the permit is specifically made subject to all other Federal, State or local statutes, laws, ordinances, rule or regulations as the same may apply to Hopper for the operation of their daycare center at the address of 223 West Vine Street, Canton, Illinois. 5. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, and approved by the Mayor thereof. a 6. That the City Clerk shall certify a copy of this Ordinance to Hopper in lieu of issuance of a separate permit. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 15th day of November 1994 , upon a roll cal l vote as follows: AYES: Aldermen Coay, Phillips, Sarff, Meade, Bohler, May, Chapman.
