HomeMy WebLinkAboutOrdinance #1444 Ordinance No . 1~+ AN ORDINANCE Vacating part of a north-south alley lying between East Linn Street and East Holly Street, within the corporate limits of the City of Canton, Fulton County, Illinois. WHEREAS, it appears to the City Council of the City of Canton, Illinois, that 65 ILCS 5/11-91-1 provides in pertinent part that whenever the corporate authorities of any municipality in the State of Illinois determine that the public interest will be subserved by vacating any street or alley, or part thereof, within their jurisdiction in any incorporated area, that said municipality may vacate that street or alley, or part thereof, by ordinance; and WHEREAS, the corporate authorities of the City of Canton, Fulton County, Illinois, have determined that the public interest will be subserved by vacating a part of a north-south alley lying between East Linn Street and East Holly Street, all as more fully hereinafter described and as designated on the attached Exhibit A, which is a plat thereof, the vacated portion of said alley being described as green therein; and WHEREAS, the alley described herein and the properties contiguous thereto are wholly within the jurisdiction and corporate limits of the City of Canton, Illinois; and WHEREAS, the corporate authorities of the City of Canton, Illinois, have determined that the relief to the public from the further burden and responsibility of maintaining the alley described herein constitutes a public use or public interest WP/1/Ord ab/9.13.96 1 w ~ authorizing the vacation; NOW THEREFORE AND BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS: Section 1. That the City Council of the City of Canton, Fulton County, Illinois, hereby finds the foregoing recitals to be fact. Section 2. That the following portion of the north-south alley lying between East Linn Street and East Holly Street in the City of Canton, Illinois, shall be and the same is hereby vacated: An alley which is 14-feet in width and is described as follows: Commencing at the Northeast corner of Lot 1, Block 1, A.J. Whitnah's Addition to the City of Canton as the Point of Beginning and running thence northerly on an extension of the East Line of said Lot 1 to the South right-of-way line of Illinois State Route 9 which point is the point of beginning of the tract to be described; thence easterly along the South right-of-way line of Illinois State Route 9, 14 feet, more or less, to a point; thence southerly 314 feet, more or less, parallel with the East lines of Lots 1,2,3,4,5 and 6 of Block 1, A.J. Whitnah's Addition to the City of Canton, Illinois; thence continuing on said line 25 feet, more or less, thereafter to a point which would be located on the center line of East Holly Street extended; thence West 14 feet, more or less, along the center line of East Holly Street, extended, to a point which is located at the point where the center line of East Holly Street, vacated, and the East 1 ine of Lots 1, 2 , 3 , 4 , 5 and 6 of Block 1, A.J. Whitnah's Addition to the City of Canton intersect; from said point, northerly 25 feet, more or less, to the Southeast corner of Lot 6, Block 1, A.J. Whitnah's Addition to the City of Canton; thence continuing northerly along the East line of A.J. Whitnah's Addition to the City of Canton, 300 feet, more or less, to the Point of Beginning, situated, lying and being in the City of Canton, County of Fulton and State of Illinois. Section 3. That the aforesaid vacation is specifically made subject to an easement or easements, in perpetuity, under, ~/~/mod sb/9.13.94 2 over and across the aforesaid vacated alley for the purpose of maintaining, constructing or reconstructing public utilities now existing therein including, but not limited to, the following: gas and electric transmission lines; water and sewer lines; and cable television lines. Section 4. The City Clerk of the City of Canton, Illinois, is hereby directed to cause a certified copy of this Ordinance to be f filed with the office of the Fulton County Recorder of Deeds immediately upon the passage and approval of this ordinance. Section 5. This Ordinance shall be in full force and effect immediately upon its passage by a majority vote of the aldermen holding office in the City of Canton, Fulton County, Illinois, October AYES: NAYS: at a regular meeting thereof on the 1Rrh day 19 ~4, upon a roll call vote as follows: Aldermen Cosy, Nblleck, Phillips, Sarff, Meade, Bohler, May, Chapman..
