ORDINANCE N0. 1428
AN ORDINANCE AOTHORIZING MODIFICATION OF THE WATER PIIRCHASE
CONTRACT BETWEEN THE CITIES OF CIIBA AND CANTON, ILLINOIS
WHEREAS, the City of Canton, an Illinois Municipal
Corporation, (hereinafter called SELLER), did contract with the
City of Cuba, an Illinois Municipal Corporation, (hereinafter
called PURCHASER), pursuant to a Water Purchase Contract dated
December 7, 1982, and,
WHEREAS, said Water Purchase Contract dated December 7,
1982, prohibits the PURCHASER from re-selling or distributing any
water outside the corporate limits of the City of Cuba, and
WHEREAS, the PURCHASER desires to have the right to re-sell
water to the residents of a subdivision located outside the
corporate limits of the City of Cuba, which subdivision is
commonly called Wee-Ma-Tuk Hills, and
WHEREAS, the City of Canton, as SELLER, is agreeable to
allow modification of said Water Purchase Contract, dated December
7, 1982.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Agreement dated December 7, 1982 between the
City of Canton and the City of Cuba pertaining to the sale of
water shall be modified to allow resale of water by the City of
Cuba to the residents of Wee-Ma-Tuk Hills, Fulton County,
Illinois.

2. That the Mayor and City Clerk of the City of Canton,
Illinois are hereby authorized and directed to execute and deliver
said agreement on behalf of the City of Canton.
3. That this Ordinance shall be in full force and effect
upon ita passage by the City Council of the City of Canton, Fulton
County, Illinois and approval by 'the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton
County, Illinois, at a regular meeting this ~~ day of June,
1994 upon a roll call vote as follows:
AYES: Aldermen Chapman, May, Sarff, Phillips, Molleck, Coay.
NAYS: None.
ABSENT: Aldermen Bohler, Meade.
