ORDINANCE N0. 1493
AN ORDINANCE AMENDING CERTAIN PROVISIONS OF TITLE 10, ZONING OF
THE CANTON CITY ORDINANCES INVOLVING CHILD CARE FACILITIES AND
OTHER TECHNICAL CORRECTIONS
WHEREAS, the Legal and Ordinance Committee of the Canton
City Council has determined that it is necessary and in the best
interest of the City of Canton to revise the zoning regulations
pertaining to child care facilities.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COONCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds the foregoing
recitals to be fact.
2. That Title 10, Chapter 5, Section 2(F) of the Canton
Municipal Code shall be amended to read as follows:
"10-5-2(F): Nursery schools, day nurseries and child care
centers; provided that for each child so cared for, there is
provided and maintained a minimum of one hundred (100)
square feet of outdoor play area. Such play space shall
have a total minimum area of at least one thousand (1000)
square feet, and shall be buffered (10-15-28) from any
adjoining lot in any residential district. (in accordance
with Chapter 15 of this title). IIp to three (3) children
may be cared for."
3. That Title 10, Chapter 5, Section 3(C) of the Canton
Municipal Code shall be amended to read as follows:
"10-5-3(C): Home occupation as as defined in Section 10-1-2
of this Title. From four (l,.) to seven (7) children may be
cared for in a child care center, nursery school or day
nursery as a home occupation in accordance with the
provisions of Section 10-1-2 and the requirements of a
buffer strip (10-15-28)."
!.. That Title 10, Chapter 7, Section 3 of the Canton
Municipal Code shall be amended to read as follows:
"10-7-3(C): "A residential structure for a home for ppersona
aged, handicapped or impaired or a rest or convalesent
home."
5. That Title 10, Chapter 8, Section 3(E) of the Canton
Municipal Code shall be amended to read as follows:
"10-8-3(E) by adding thereto: A child care center, nursery
school or day nursery with no limit on the number of
children provided that the provisions of state law and
Chapter 15 of this title are complied with.
6. That Title 10, Chapter 9, Section 3 of the Canton
Municipal Code shall be amended to read as follows:
"10-9-3 is amended as follows: (B) 7, 8, 9, 10 and 11 are
redesignated as (C) (D) (E) (F) and (G) and adding thereto
(H) A child care facility as in a B-2 District."
7. That this Ordinance shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois and approval by the Mayor
thereof.
PASSED by the City Council of the City of Canton, Fulton
County, Illinois, at a regular meeting this 19th day of
December , 1995.
