HomeMy WebLinkAboutOrdinance #1492 ORDINANCE N0. 1492 AH ORDINAHCE FOR LICENSING AND REGULATING ITINERANT SALES PERSONS AND TRANSIENT MERCHANTS AND REPEALING INCONSISTENT ORDINANCES 3-2-1: 1: It shall be unlawful within the City of Canton, Illinois to offer for sale or to sell tangible personal property from motor vehicles or unoccupied lots except in a proper commercial zone, in compliance with the "open air business" rules and with a license in accordance with this ordinance. 3-2-2: All licenses required by this ordinance shall be applied for at the Police Department on forms prescribed by said department. The forms shall require the following basic information: (Additional information may be required, depending upon the nature of the business.) a. The applicant's name. b. The applicant's permanent business address which must include a street address. A post office box is not sufficient. c. The applicant's residence address, and if the applicant is a corporation, the residence address of it's officers. d. The location at which the applicant intends to conduct business. e. The nature of the business which the applicant intends to conduct. f. A copy of the applicant's certificate of registration under the Retailers' Occupation Tax Act. g. A complete inventory of the goods applicant intends to sell. h. A list of all licenses to conduct business as a transient merchant or an itinerant vendor in the past 12 months obtained by applicant in Illinois. 3-2-2a: Each applicant must file a surety bond or cash deposit of not less than $1,000 or more than $10,000 based on 50~ of the wholesale value of the merchandise. a. All licenses under this ordinance shall be issued by the City Clerk after approval by the Police Department. b. No licenses may be issued until the bond or deposit is filed. c. Any deposit or bond shall be transferred to -the Attorney General of Illinois within 14 days after the applicant ceases to do business in the City of Canton. 3-2-2b: All licenses issued hereunder shall expire as of December 31 of the year issued, unless specified otherwise. 3-2-3: It shall be unlawful within the City of Canton to solicit door-to-door for property repairs or improvements, including but not limited to driveway repair, resealing, chimney repair and roof repair without first obtaining a license therefor. Licensing under this section shall require proof of current insurance. Licensees shall also provide a warranty, limited or general, regarding work performed. 3-2-3a: Sales of farm products will be permitted as provided by state statute however so-called "farmers markets" will not be permitted to allow the sale of items produced by persons, firms, etc. other than the seller or the seller's family. Door-to-Door repair, etc. Initial $50.00 Per day additional $20.00. 3-2-3d: Nothing contained in this ordinance shall preclude delivery of goods purchased on order, nor shall it apply to school activities, school clubs or not for profit charitable fund drives. 3-2-3e: The terms "transient merchant" and "itinerant vendor" shall have the meanings set forth in the definitions section of the Transient Merchant Act of 1987. (225 ILCS 465/1 et seq.) 3-2-3f: Such license fee shall be paid in full cash to the City before any requested license shall issue. No refunds of license fees (or any portion thereof , shall be made. Licenses hereunder are nod transferable. No license for the sale of food items for human consumption shall issue hereunder unless the applicant presents the City with the original of the appropriate Fulton County Health Department license or permit relating to the contemplated sales. 3-2-3 Violations of this ordinance shall be punishable by a fine of 75.00 for each violation. The police department is authorized to seize trucks or other vehicles and personal property involved in unlicensed sales. 3-2-3h: All inconsistent ordinances are hereby repealed and Sections 3-2-1, 3-2-2 and 3-2-3 of the City of Canton Code are specifically repealed. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 1 h day of December, 1995 upon a roll call vote as follows: AYES: Aldermen Molleck, Hartford, Sarff, Phillips, Bohler, Meade, Shores, May.
