ORDINANCE NO. 1486
AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE
OPERATION OF A DRIVE-IN RETAIL FOOD FACILITY AT THE
ADDRESS OF 167 SOUTH FIFTH AVENUE, CANTON, ILLINOIS.
(ADDITIONAL REAL ESTATE)
WHEREAS, it appears to the City Council of the City of Canton,
Fulton County, Illinois, that the territory hereinafter described is located
within the corporate limits of the City of Canton; and,
WHEREAS, a petition was filed by Richard and Karen Maurer,
owners of said real estate to the Planning and Zoning Commission of said
city requesting a special use for additional real estate acquired since the
Council granted a special use on July 5,1995 for this purpose.
WHEREAS, notice of a petition for a special use permit in a B-2
general commercial district was published within said City and County, all
in accordance with the Statutes of the State of Illinois and the Ordinances of
the City of Canton; and,
WHEREAS, no objectors appeared at said hearing and said
commission did thereupon make favorable findings of fact and did
recommend to the Canton City Council that said special use for the
additional real estate for the drive-in facility at 167 South Fifth Avenue be
allowed.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as
follows:
1. That the City Council of the City of Canton, Fulton County,
Illinois, hereby finds the foregoing recitals to be fact.

2. That a special use permit for the operation of a drive-in retail food
facility be issued to RICHARD and KAREN MAURER, at the address of
167 South Fifth Avenue, Canton, Illinois, affecting real property being
legally described as follows:
A part of Lots 90 and 91, Barnes & Jones Addition to the City of Canton,
Fulton County, Illinois, described as follows:
Beginning at a point 100 feet South of the Northwest corner of Lot Number
90, thence East 110 feet, thence South 50 feet, more or less, to the North
side of East Walnut Street, thence West I10 feet, thence North 50 feet,
more or less, to the point of beginning; all situated in the City of Canton,
Fulton County, Illinois
Subj~t to that portion of said Lots No. 90 and 91 in said Barnes and Janes'
Addition to the City of Canton, Faulton County, Illinois, taken, used
and/or dedicated for a public street on the South side of said Lots.
3. That the records of the City of Canton, appropriate documents,
maps and related regulations be, and the same hereby are, amended to reflect
the foregoing special use permit granted herein.
PASSED by the City Council of the City of Canton, Fulton County,
Illinois, at a regular meeting this 7th day of November ,1995,
upon a roll call vote as follows:
AYES: Aldermen Molleck, Hartford, Sarff, Phillips,
Meade, Shores, May,
NAYS: None .
ABSENT: Alderman Bohler .
