AN ORDINANCE VACATING SOIITHVIEW ACRES SIIBDIVISION
WHEREAS, on June 20, 1978 the City Council of the City of
Canton, by ordinance approved the final plat of Southview Acres as
a subdivision of the City of Canton; and,
WHEREAS, it was stipulated that the storm sewer planned for
Tamarack Street be designed to provide for extension to the future
South Second Avenue; and,
WHEREAS, the contractor, owner, developer was to provide a
perf ormance bond of $125,000.00, or to provide in partial lieu
thereof certain construction amenities; and,
WHEREAS, neither the design of the storm sewer was changed
nor was the sewer nor water installed; and,
WHEREAS, no performance bond was ever filed; and,
WHEREAS, the danger exists that conveyances will be made
with the erroneous assumption that the normal subdivision
requirements have been met.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the approval of Southview Acres Subdivision on or
about June 20, 1978 be and the same is hereby rescinded.
2. That the easements are retained for all water and sewer
lines in place.
3. That the City Clerk shall cause this ordinance to
recorded with the land records of Fulton County, Illinois.

1.. That the appropriate changes be made to the corporate
maps of the City noting there be no change to the corporate
limits.
5. That the zoning shall remain unchanged.
6. That this Ordinance shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton and approved by the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 15th day of
August , 1995 upon a roll call vote as follows:
AYES: Aldermen May, Shores, Meade, Phillips, Sarff, Hartford,
Molleck.
NAYS: None
ABSENT: Alderman Kohler.
