HomeMy WebLinkAboutOrdinance #1473ORDINANCE NO. 14 7 3 AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE OPERATION OF A DRIVE-IN RETAIL FOOD FACILITY AT THE ADDRESS OF 167 SOUTH FIFTH AVENUE, CANTON, ILLINOIS. WHEREAS, it appears to the City Council of the City of Canton, Fulton County, Illinois, that the territory hereinafter described is located within the corporate limits of the City of Canton; and, WHEREAS, a petition was filed by Richard and Karen Maurer, owners of said real estate to the Planning and Zoning Commission of said city requesting a special use; and, WHEREAS, notice of a petition for a special use permit in a B-2 general commercial district was published within said City and County, all in accordance with the Statutes of the State of Illinois and the Ordinances of the City of Canton; and, WHEREAS, no objectors appeared at said hearing and said commission did thereupon make favorable findings of fact and did recommend to the Canton City Council that said special use for the drive-in facility at 167 South Fifth Avenue be allowed. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the City Council of the City of Canton, Fulton County, Illinois, hereby finds the foregoing recitals to be fact. 2. That a special use permit for the operation of a drive-in retail food facility be issued to RICHARD and KAREN MAURER, at the address of 167 South Fifth Avenue, Canton, Illinois, affecting real property being legally described as follows: Apart of Lots 90 and 91, Barnes & Jones Addition to the City of Canton, Illinois, described as follows: Beginning at the Northwest corner of said Lot 90, thence East 156.6 feet, thence South along the East line of said Lot 91 to the North line of East Walnut Street, thence West 47.5 feet, thence North to a point 100 feet South of the North line of said Lot 91, thence West 109.b feet more or less to the West line of Lot 90, thence North 100 feet to the glace of beginning. 3. That the records of the City of Canton, appropriate documents, maps and related regulations be, and the same hereby are, amended to reflect the foregoing special use permit granted herein. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 5th day of July,1995, upon a roll call vote as follows: AYES: Aldermen May, Shores, Meade, Phillips, Sarff, Hartford, Molleck. All interest citizens will be given an opportunity to be heard at the meeting, Subsequent to the public hearing and before the final action is taken on the proposed appropriation ordinance the corporate authorities of the City of Canton may revise,alter, increase or decrease the items contained in said appropriation ordinance.
