HomeMy WebLinkAboutOrdinance #1467L ORDINANCE N0. 14~i7 AN ORDINANCE AMENDING TITLE 6, CHAPTER 4 OF THE CANTON MQNICIPAL CODE BY ADDING SECTION 8 CONCERNING THE KEEPING, BREEDING, CARING FOR AND POSSESSING CERTAIN BIRDS AND ANIMALS WITHIN THE CITY OF CANTON, ILLINOIS WHEREAS, the Legal and Ordinance Committee of the City of Canton has determined that it is necessary and in the best interest of the City of Canton and its citizens to regulate the keeping, breeding, caring for and possessing certain birds and animals; and, WHEREAS, the City Council of the City of Canton has made a similar determination. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Fulton County, Illinois as follows: 1. That Title 6, Chapter 4 of the Canton Municipal Code be amended by adding Section 8 as follows: "6-4-8: KEEPING, BREEDING, CARING FOR AND POSSESSING CERTAIN BIRDS AND ANIMALS: A. Definitions. The following words, terms and phrases when used in this ordinance, shall have the meaning ascribed in this section, except where the context clearly indicates a different meaning: "Animal" means every non human species of animal, both domestic and wild. "Cat" means all domestic members of the feline family, felis catus. "Dog" includes all domestic members of the canine family, Canis familiaris. "Domestic animals". The following are considered to be domestic animals: (1) Dogs (not including hybrids of dogs) (2) Cats (not including hybrids of cats) (3) Domestic rodents (hamsters, guinea pigs, white mice, white rats etc.) (L,.) Farm animals (equines, bovines, swine, ovine, caprine, poultry and rabbits) (5) Non-life threatening, non-poisonous reptiles or amphibians (6) Non-life threatening, nonpoisonous fish (7) All birds, except those protected as wild birds by State or Federal statute "Exotic animals" means any non domestic animal not native to the state. "Keep" means owning, possessing or harboring. The term "harboring" shall include regular feeding. "Wild animal" means any living member of the animal kingdom (including exotic animals) other than a domestic animal. B. No person, partnership, firm or corporation shall keep, harbor, possess, care for, act as custodian for or have a right of property in: 1.) a wild animal (including, but not limited to, all animals enumerated in Section 1 of the Dangerous Animal Act of Illinois) except circuses, zoos, veterinary hospitals or clinics, animal shelters which must be legally licensed pursuant to federal and/or state statutes, or facilities licensed and regularly inspected by the U.S.D.A. and which are located within a proper zoning classification. 2.) any animal or bird which has been declared "rare" and/or "endangered" by any national government, recognized international organization or by interim treaty, including animals listed in the Federal Animal Welfare Act. 3.) any exotic animal or bird. C. No person shall sell, lease or transfer any of the animals described in Section B(1) except to a legally licensed dealer, circus or zoo. D. No person shall keep no more than four (L,.) dogs at any one time except in the case of puppies born which case the owner shall have a period of or give away the puppies in order to reduce level. E. No person shall keep more than any one time, except in the case of kittens to a female dog in six (6) months to sell the number to a lawful Four (L,.) adult cats at born to a female cat in which case the owner shall have three (3) months to sell or give away kittens to achieve the lawful number. F. No person shall keep more than four (1,.) adult rabbits at any one time, except in the case of baby rabbits in which case the owner shall have 8 months to sell or give away rabbits to achieve the lawful number. G. Except as otherwise provided in the zoning ordinances of the City of Canton, all farm animals, including those classified as pets, shall be prohibited. H. Violations of this ordinance shall cause a penalty to be issued in the form of a fine of not less than $75.00." 2. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 6th day of June , 1995, upon a roll call vote as follows: AYES: Aldermen Molleck, Hartford, Sarff, Phillips, Bohler, Meade, Shores, May.
