ORDINANCE NO. 3081 AN ORDINANCE DESIGNATING AN AREA WITHIN THE CITY OF CANTON AND THE COUNTY OF FULTON AS AN ENTERPRISE ZONE Whereas, the Illinois Enterprise Zone Act was certified and officially became law on December 7, 1982 and was amended in 2012. Under the new provisions, all existing zones expire. The legislature has since amended the Illinois Enterprise Zone Act ("Act"), 20 ILCS 655/1, et al, requiring all municipalities and counties apply for new zones by December 31, 2014 and, Whereas, the City of Canton intends to cooperate with the County of Fulton in designating an Enterprise Zone under the provisions of the Act; and Whereas, on October 20, 2014, the City of Canton and County of Fulton held a public hearing within the proposed zone area on the question of whether to create the zone, what local plans, tax incentives and other programs should be established in connection with the zone, and what the zone boundaries should be; and Whereas, it is necessary that a formal application be made for approval of the said designation to the Illinois Department of Commerce and Economic Opportunity by December 31, 2014, said application to contain information on the proposed Enterprise Zone and the cooperating entities plans for the proposed zone. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the City of Canton hereby initiates and designates, subject to the approval of the Department of Commerce and Economic Opportunity, and supports the intent of the County of Fulton to initiate and designate as an Enterprise Zone, the area described in Exhibit A attached hereto; 2. That the City of Canton finds that the designated Enterprise Zone area is a contiguous area, at least one-half(1/2) square mile and not more than twelve (12) square miles, exclusive of lakes and waterways, and is entirely located within the County of Fulton and partially within the municipality of the City of Canton as is reasonably necessary for the establishment of such zone; 3. That the City of Canton and County of Fulton meet at least three (3) or more of the criteria contained in Section 4(� of the Act, including but not limited to: (1) all or NLR Ordinances 10/30/14 part of the local labor market area has had an annual average unemployment rate of at least 120% of the State's annual average unemployment rate for the most recent calendar year or the most recent fiscal year as reported by the Department of Employment Security; (2) that 50% or more of the children in the local labor market area participate in the federal free lunch program according to reported statistics from the State Board of Education; (3) that the proposed zone includes an abandoned coal mine, a Brownfield as defined in Section 58.2 of the Environmental Protection Act, and all or a portion of the proposed zone has been declared a federal disaster area within the past (3) years; and (4) high schools and the community college within the proposed zone are engaged in ACT Work Keys, Manufacturing Skills Standard Certification, or other industry-based credentials that prepare students for careers. 4. That the City of Canton and the County of Fulton hereby provide for those tax incentives or reimbursement for taxes set forth is Exhibit B attached hereto, which pursuant to state and federal law apply to business enterprises within the zone at the election of the County of Fulton or the City of Canton, and which are not applicable throughout the County or City. Improvements in the Canton/Fulton County Enterprise Zone are eligible for real estate tax abatements as long as the property is not located in a tax increment finance district. Should the Zone boundaries overlap an area in the City or the County that has been designated as a Tax Increment Finance District, the property taxes shall be paid according to the allocation set forth in the tax increment finance district designation documents Property located in the t� increment finance district is not eligible for the Zone tax abatements. Illinois Enterprise Zone Act 65 ILCS 5/11-74.4-8. The offering of ways and means to stimulate development within the Zone shall be offered for the duration of the Zone as set forth in Exhibit B. The City and County agree to an exemption from sales tax on building materials used in the construction, rehabilitation, or renovation of real estate located within the Zone with proper building permits that are required and obtained. The building materials exemption will be available only to those contractors or other entities with a certificate issued by the lllinois Department of Revenue. NLR Ordinances 10/30/14 5. That pending the approval by the Department of Commerce and Economic Opportunity, the proposed zone described in Exhibit A is designated as an Enterprise Zone; 6. That the Enterprise Zone shall be in effect for fifteen(15) calendar years commencing on January 1, 2016. After the 13t" year, the Zone is subject to review by the Enterprise Zone Board for an additional ten (10) year designation beginning on the expiration date of the enterprise zone; 7. That the City of Canton will serve as the lead agency in the application process; 8. That the City of Canton will be responsible for the overall administration of the Enterprise Zone Program and the Mayor of the City of Canton shall appoint an employee or elected official to serve as the Zone Administrator, with the advice and consent of the City Council. The County does not have a county administrator and therefore felt that it was in the best interest of the Zone that the City's Mayor, or his designee, be named as the Zone Administrator since that position will always be filled and since the City is the largest community within the County and the Mayor is an elected official representing the largest population within the County. According to the U.S. Census Bureau, in 2012, the City had a population of 14,704 and the County's total population was 37,069. If the Mayor fails to appoint a representative to serve as the Zone Administrator, the City Comptroller shall act as the Administrator; and 9. The Zone Administrator's duties shall include but not be limited to the following: accept applications for implementation of zone incentives and objectives; prepare application forms for tax credits and abatements; certify the applicant qualifies for such tax credits or abatements; post Zone boundaries on the City of Canton's website, collect and aggregate Zone data; file Zone fee schedule with the Department of Commerce and Economic Development; apply to the Illinois Department of Revenue for sales tax exemption certificate; collect and submit Zone application or administrative fees; develop and recommend a comprehensive planning program for the Zone; coordinate planning activities and program implementation with other City and County department programs; act as liaison between the municipalities, county, and any designated zone organization, any Federal agency and any local NLR Ordinances 10/30/14 planning groups in support of the Zone Program and Plan; act as a liaison between the Zone units of government and the Department of Commerce and Economic Opportunity; act as program manager responsible for the Zone's day to day operations. 10. That the City of Canton will be responsible for the overall administration of the Enterprise Zone Program and the mayor of the City of Canton shall serve as the Zone Administrator; 11. That there shall be created an Enterprise Zone Advisory Committee whose function it shall be to recommend guidelines and criteria for the administration of the zone program, to oversee the administration of the program and to serve the Zone Administrator in an advisory capacity. The Enterprise Zone Committee shall consist of the following (1) City officials: Mayor, City Community Services Director, City Engineer; City Attorney, and City Planning & Zoning Administrator; (2) the following County officials: County Board Chairman, County Clerk, County Supervisor of Assessments, and one additional County representative; and (3) all other taxing bodies representatives: each year, the Committee shall notify each taxing body of its first meeting and should any of the other taxing bodies choose to have a representative on the Committee, the taxing body shall have the ability to appoint one (1) representative to the Committee for that year. The Director of the Spoon River Partnership for Economic Development or its representative shall serve on the Committee in an advisory capacity only and shall not have any voting ability; 12. That the City of Canton may, pursuant to Section 8 of the Act, designate one or more organizations provided for in the Enterprise Zone Act as designated Zone Organizations and may provide services according to those allowed under Section 8 of the Act. 13. That the Mayor of the City of Canton, or his designee, shall execute such documents as may be necessary for making the required application and said Mayor, or his designee, shall be authorized to provide such additional information as may be required by the Department of Commerce and Economic Opportunity; NLR Ordinances 10/30/l4 14. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the Ciry of Canton, Fulton County, Illinois and approval by the Mayor thereof.
