HomeMy WebLinkAboutOrdinance #1447-AORDINANCE N0. 14+7 -A AN ORDINANCE PROVIDING FOR THE MANNER OF SALE OF CERTAIN REAL PROPERTY OWNED BY THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, the City of Canton is the owner of record of certain parcels of real property hereinafter described; and, WHEREAS, the Community and Industrial Development Committee has determined that the real property hereinafter described is no longer necessary, appropriate, required for the use of, profitable to, or for the best interest of the City of Canton; and, WHEREAS, the City Council of the City of Canton has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That real property presently owned by the City of Canton, being located and legally described as follows, to-wit: PARCEL NUMBER ONE: Legal Description: Lot Number Thirty- Seven (37) in W.N. Maloney's Addition to the City of Canton, Fulton County, Illinois Common Address: 818 Anderson Place Canton, Illinois PARCEL NUMBER TWO: Legal Description: Sixty-seven (67) feet off the North end of Lot Number Ten (10) in Block One (1) of Edgewood Addition to the City of Canton. Common Address: 486 West Locust Street Canton, Illinois PARCEL NUMBER THREE: Legal Description: Apart of the Southwest Quarter of Section 26, Township 7 North, Range 4 East of the Fourth Principal Meridian, described as follows: Commencing at the Southwest intersection of East Chestnut Street and North Fifth Avenue running thence West 42 feet, thence South 79 feet and 9 inches, more or less, to a point 153 feet North of the North line of Lot 39 in BARNES and JONES ADDITION to Canton, Illinois, thence East 42 feet, thence North 79 feet and 9 inches, more or less, to the place of beginning; ALSO, the perpetual use for driveway purpose of the West half of an 8 foot driveway, the center of which is the West line of the above-described lot, and excepting the like use of the East half of said driveway, which has been granted to Ethel Young, her heirs and assigns, EXCEPTING, Commencing at the intersection of the West right-of-way line of 5th Avenue and the South right- of-way line of Chestnut Street for a point of beginning and from said point run South 0 degrees 27 minutes 52 seconds West along said West right-of-way line 15.02 feet; thence North 41 degrees 31 minutes 53 seconds West 20.11 feet to a point on the South right-of-way line of Chestnut Street; thence South 89 degrees 51 minutes 50 seconds East along said South right-of-way 13.46 feet to the point of beginning and containing 101.09 square feet, more or less. be let for bids for the sale of such property under the direction of the City Council, with the advice of the City Attorney, and in conformity with the laws of the State of Illinois and the Ordinances of the City of Canton thereto appertaining. 2. That public notice of the foregoing proposed sales shall be as by law made and provided. 3. That the use of each of the foregoing parcels of real estate has been residential in nature and that the present use of each of the aforesaid parcels is as determined by reference to the City of Canton's zoning ordinance and map, as the same may be from time to time amended. 4. Conveyance of title to any successful bidder shall only be by a corporate quit-claim deed. 5. The City of Canton shall show merchantable title to any successful bidder by either, in the City of Canton's sole discretion, abstract of title, or a commitment to insure title in the amount of the purchase price. 6. The City of Canton reserves the right by majority vote to reject any and all bids and with respect to each and all of the foregoing parcels of real property; or, to accept the high bid(s) or any other bid(s) determined to be in the best interest of the City of Canton by a vote of 3/4 of the corporate authorities then holding office. 7. Bids shall be submitted to the City Clerk, City Building, 210 East Chestnut Street, Canton, Illinois 61520, on or before February 14, 1995, at 5:00 o'clock P.M., local time. Late bids will not be considered. All bids submitted shall be opened before the Clerical Committee at its regular meeting of February 14, 1995. 8. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 3rd day of January 1995, upon a roll call vote as follows: AYES: ~~~ ~P~, May, Bohler, Sarff, Phillips, Molleck, Coay.
