ORDINANCE NO. 1510
AN ORDINANCE CREATING TITLE 6, CHAPTER 19, SECTIONS 1 THROUGH
4, PROHIBITING LOITERING IN PUBLIC PLACES IN THE CITY OF
CANTON, ILLINOIS
WHEREAS, Citizens should be able to utilize public places without hindrance or
harassment; and,
WHEREAS, Persons who loiter, loaf or otherwise remain idle in public places
tend to inhibit full use and utilization of said public places; and,
WHEREAS, The peace and tranquility of public places in the City of Canton is
threatened by the presence of persons who remain idle or consort with others to loaf or
obstruct free passage of other citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CANTON, Fulton County, Illinois as follows:
6-19-1: It shall be unlawful for any person to loiter, loaf, wander, stand or remain
idle either alone or in consort with others in a public place in such manner so as to:
A. Obstruct any public street, highway, sidewalk, alley, parkway, parking lot, park
or any other public place or any building by hindering or impeding or tending to hinder or
impede the free and uninterrupted passage of vehicles, traffic or pedestrians; or,
B. By his presence or in consort with others, interfere with or interrupt the
conduct of pedestrian movement, motor vehicular traffic or business in such stores or
shops or in the offices located in any such building in the city; or,
C. Sit, lie, stand, kneel, recline, or place lawn chairs, etc., on any improvement
such as walls, retaining fixtures, sidewalks, and curbing or on any such improvement
which is not specifically provided for or intended for such purpose or use in any public
place in the City; or,

D. Commit in or upon any public street, highway, sidewalk, alley, parkway,
parking lot, park or any other public place or any building any act or thing which is an
obstruction or interference to the free and uninterrupted use or enjoyment of property or
with any business lawfully conducted by anyone in or upon or facing or fronting on any
such public street, highway, sidewalk, alley, parkway, parking lot, park or any such public
place or any building, all of which prevents the free and uninterrupted ingress, egress, to
and from such premises; or,
E. Engage in activities, make loud noises, consume alcoholic beverages or create
circumstances that afford probable cause for alarm or concern for the safety and well
being of persons or for the security of public or private property in the surrounding area.
6-19-2: Loitering by minors: No parent or guardian of a minor under the age of
eighteen (18) years shall knowingly permit the minor to loiter in violation of this Chapter.
6-19-3: Definitions: As used in this section:
A. "Loitering" means remaining idle in essentially one location and includes the
concept of spending time idly; to be dilatory; to linger; to stay; to saunter; to delay; to
stand around and also includes the colloquial expressions, "hanging around" and "hanging
out".
B. "Public place" means any place to which the general public has access and a
right to resort for business, entertainment or other lawful purpose, but does not
necessarily mean a place devoted solely to the use of the public. It also includes the front
or immediate area of any store, shop, restaurant, tavern or other place of business, and
also public grounds, sidewalks, areas or parks.
C. "Police action" shall mean when any person causes or commits any of the acts
enumerated in this Section, a police officer, or any law enforcement officer, shall order
that person to stop causing or committing such acts and to move on or disperse. Any
person who fails or refuses to obey such orders is guilty of a violation of this Section.
6-19-4: PENALTY: A person convicted of a violation of any provision of this
Chapter shall be fined not less than twenty-five dollars ($25.00) no more than two
hundred dollars ($200.00), exclusive of court costs.
1. That this ordinance shall be in full force and effect immediately upon its passage
by the City Council of the City of Canton, Fulton County, Illinois.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting this 2 0th day of August 199 6 upon a roll call vote as
follows:
