SWISE AT THE NORTHEAST CORNER OF FOURTH AVENUE AND EAST LOCUST STREET BEING PARTS OF LOTS 1 AND 2 IN BLOCK 1 IN KELLOGGrBABCOCK' S ADDITION TO THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, a petition was filed with the City Clerk for the rezoning of the real property described below, and said real property is within the corporate limits of the City of Canton, Illinois; WHEREAS, the current zoning of the subject premises is R-4 and it is the intention of the owners that it be changed to a zoning of B-2; and WHEREAS, a public hearing on said petition was conducted by the Planning and Zoning Commission of the City of Canton on July 8, 1996 pursuant to proper notice having been published in the Canton Daily Ledger; WI~REAS, on July 8, 1996 the Planning and Zoning Commission recommended to the City Council that the real property described in the attached exhibit hereto be rezoned in the City of Canton pursuant to Division 13, Article 11, Act 5, Chapter 65, Illinois Compiled Statutes, 1992 (65 ILCS 5/11-13-1 et set; and, WI~REAS, it is in the best interest of the City of Canton, Illinois that said real property be rezoned in the City of Canton. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: That the Canton City Counsel hereby finds as facts the assertions set forth above. 2. That the described real property be and is hereby rezoned as follows: Lots One (1) and Two (2) in Block One (1) in Kellogg and Babcock's Addition to Canton, Fulton County, Dlinois excepting the following described parcel: Beginning at the Southwest Corner of Lot One (1) being also the Northeast corner of the intersection of Fourth Avenue and Locust Streets; thence Northerly Six (6) feet along the West line of Lot One (1); thence Southeasterly 7.67 feet to a point that is North 4.0 feet from the South line of Lot One (1); thence Easterly 113.56 feet to a point 2.0 feet North of the South line of Lot Two (2); thence South 2.0 feet to the Southeast corner of said Lot Two (2); thence Westerly along the South line of Lots One (1) and Two (2); also being the North right-of--way of Locust Street 120.94 feet to the point of beginning containing 377.62 square feet more or less, from R-4 to B-2. 3. That the Zoning Administrator is directed to make the appropriate changes to the zoning maps of the City of Canton to show this rezoning. 4. That the City Clerk is directed to record with the Recorder of Deeds of Fulton County and to file with the County Clerk of Fulton County a certified copy of this ordinance. 5. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton and approval by its Mayor. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 6 th day of August , 1996 upon a roll call vote as follows: AYES: Aldermen Molleck, Hartford, Sarff, Phillips, Nidiffer, Shores , clay .
