ORD 2 NANO E NO _ 1508
AN ORDINANCE
Annexing certain property owned by David O. Bell and
Twila B. Bell to the City of Canton, Fulton County,
Illinois, in an R-2 zoning configuration.
WHEREAS, it appears to the City Council of the City of Canton,
Illinois, that the territory hereinafter described is not located
in any municipality, but that the same is located outside the
corporate limits of said City of Canton; and
IT FURTHER APPEARING to said City Council that the territory
hereinafter described is contiguous to the City of Canton along its
South boundary line thereof; and
IT FURTHER APPEARING to said City Council that a Petition for
Annexation and Rezoning has been filed by the Petitioners, David O.
Bell and Twila B. Bell, requesting that the property hereinafter
described be annexed to the City of Canton in an R-2 zoning
configuration; and
IT FURTHER APPEARING to said City Council that a public
hearing was conducted by the Planning & Zoning Commission of the
City of Canton, Illinois, in accordance with the laws of this State
and the ordinances of the City of Canton, Fulton County, Illinois,
on July 8, 1996, and said Planning & Zoning Commission unanimously
recommended that the property hereinafter described be annexed to

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, ILLINOIS:
Section 1. That the territory described as follows:
All of Lots 6,7, and 8; Lots 9 and 10 excepting a piece
of land 84.5 feet East and West by 160 feet North and
South in the Southwest Corner of said Lot 10, and
excepting a part of Lots 9 and 10 bounded and described
as follows: Beginning at a point 31 feet West of the
Southeast corner of Lot 10, thence North 160 feet, thence
East 100 feet, thence South 160 feet, thence West 100
feet to the Place of Beginning; and part of Lot 11,
beginning at the Northeast Corner of said Lot 11, running
thence West 15.5 feet, thence South 216.5 feet, thence
East 15.5 feet, thence North 216.5 feet to the Place of
Beginning; ALL IN BABCOCK'S QUALITY HILL FOURTH ADDITION
to the City of Canton, situated in the County of Fulton,
State of Illinois;
be and the same is hereby annexed to the City of Canton, County of
Fulton, State of Illinois, in accordance with the applicable rules,
laws and regulations of the Illinois Municipal Code.
Section 2. That the above-described property shall be and
the same is hereby designated with an R-2 zoning configuration,
single family residential.
Section 3. That the City Zoning Administrator is hereby
instructed and ordered to make the necessary adjustments to the
zoning map of the City of Canton, Illinois, to reflect the
annexation and rezoning hereunder.
Section 4. That the City Engineer of the City of Canton,
Illinois, is instructed to prepare an appropriate plat reflecting

the addition of the above-described property to the City of Canton
by virtue of the annexation herein and to make same a part of the
permanent records of the City of Canton, Illinois.
Section 5. That this Ordinance was passed and became in
full force and effect immediately upon its passage by a majority
vote of the aldermen holding office in the City of Canton, Fulton
County, Illinois, at a regular meeting of the City Council of the
City of Canton, Illinois, this ~~ day of August
1996, upon a roll call vote as follows:
AYES: Aldermen May, Shores, Ndif,fer, ~'hllps, Sarff, Hart
ford, Molleck.
NAYS: None.
ABSENT: Alderman Meade,

GARY E . BARNHART, being first duly sworn and upon oath deposes
and says as follows:
1. That the undersigned, as a member of the firm of Claudon,
Lloyd, Barnhart & Beal, Ltd. , 121 West Elm Street, Canton, Illinois
61520, represents David O. Bell and Twila B. Bell concerning the
annexation of certain property which is contiguous to the City of
Canton, Fulton County, Illinois, and which is described on Exhibit
A, which is attached hereto and made a part hereof by reference.
2. That the undersigned caused to be mailed by Certified
U.S. Mail, the Notice of annexation which is attached hereto and
made a part hereof by reference as Exhibit B to the Copperas Creek
Fire Protection District (Certified Mail #P244-683-657) and Parlin
Ingersoll Library (Certified Mail #P244-683-656).
3. The the foregoing Notice was sent in accordance with
Section 7-1-1 of the Illinois Municipal Code (65 ILC5 5/7-1-1).
