AN ORDINANCE establishing charges and rates for the use and service of the combined waterworks and sewerage system of the City of Canton, Fulton County, Illinois� � � � �- � � WHEREAS, the City of Canton, Fulton County, Illinois, has heretofore, by ordinance duly adopted, provided for the construction of improvements and extensions to the waterworks and sewerage system in and for said City; and the issuance of Waterworks and Sewerage Revenue Bonds to defray the cost of constructing such improve- ments and extensions to the waterworks and sewerage system pursuant to and in com- pliance with the provisions of the Illinois Municipal Code, effective July l, 1961, and all laws amendatory thereof and supplementary thereto; and WHEREAS, pursuant to the terms of the Code above referred to and the ordinance heretofore passed.authorizing the construction of the needful improvements and extensions to the combined waterworks and sewerage system and the issuance of said bonds, it is necessaxy that the City charge the inhabita,nts thereof for the use thereof and the services supplied by said combined waterwor.lcs and sewerage system, establish rates therefor, and provide for the collection thereof: 1�'OW, TH�REF'ORE, Be It Ordained by the �{ty Cc?:��c3i of the City of Canto�i, Fulton County, Illinois, as follows: Section 1 (a) . That there shall be and there are hereby established rates or charges for the use of and for the service supplied by the combined waterworks and sewerage system of the City of Canton, Fulton County, Illinois, based u'�. � the amount of water consiuned, as shown by the water meters, as follows: Section 1 (b) . WATER RATES ONLY Minim�nn monthly charge for Water Only shall be $2.00. Fixst 700 cu. ft. per m�nth $0.65 per 100 cu. ft. Next 2,500 cu. ft. per month 0.62 per 100 cu. ft. Next 3,500 cu. ft. per month 0.52 per 100 cu. ft. Next 7,000 cu. ft. per month 0.48 per 100 cu. ft. Next 13,000 cu. ft. per month 0.46 per 100 cu� ft, Next 20,000 cu. ft. per month 0.43 per 100 cu. ft. Next 25,000 cu. ft. per month 0.41 per 100 cu. ft. Sa,id rates or charges for the service shall be payabl��monthl�- ��. on the first day of ac mo�th. The owner of the premises, the occupant thereof and the user of the sexvice shall be jointly and severally liab le to pay for the service on such premises and the service furnished to the premises .by the City of �Canton �zl �� the eondition that the owner of the premises, occupant and user of the service are jointly and severally liab 1e therefor to the City of Canton. Al1 bills for service shall be rendered onthly on the first day of the month and shall be payable not later than the close of business on the lOth day of their dat+e+:' If payment of the full amount of the bill is made after said period then a penalty of ten per cent (10°�0� of the amount of the bill shall be added thereto. Section 3• In the event the charges for service axe not paid within thirty 0 days after rendition of the bill for such service, such charges shall be deemed (3 ) ancl are hereby declared to be delinquent, and thereafter such delinquencies shall lied and the constitute liens upon the real estate for which such service is supp � City Clerk is hereby authorized and directed to file sworn statements showing such delinquencies in the office of the Recorder of Deeds of Fulton County, Illinota, and the filing of such statements shall be deemed notice for the payment of such charges for aervice. Section �+, No water shall be turned on for use on or in any Pr emises until an application therefor in writing has been made for that purpose and filed with the City Clerk of said City, stating the purpose for which the water is to be used. If the applican� is not the owner in fee simple of the recorded title to - 2 - . � � � . , , • `�. . . - . . . � p�operty w,here the applicant desires the water to be turned on, he shall deposit with his application the siun of Ten Dollars ($10.00) before any water is turned on. Such deposit shall be held by the City of Canton, as security for the payment of water used by the applicant and may be so applied when any default is made in payment of a water bill. Section 5. If the rates or charges for such service axe not paid within thirty (30) days after the rendition of the bill for such services, such service shall be discontinued without further notice and shall not be reinstated until all past due bills, including the penalties thereon, are paid in full. Section 6. It is hereby made the duty of the City Clerk of the City of Canton, or qualified personnel appointed by the Mayor and City Council, to render bills for service and for all rates and charges in connection therewith and to collect all moneys due thereon. Section 7. All revenues and moneys derived from the operation of the com- bined waterworks and sewerage system shall be held by the City Clerk or qualified personnel appointed by the Mayor and City Council, to render bills for service and for all r�tes and charges in connection therewith and to collect a11 moneys due thereon, separate and apart f�om his private funds and separate and apart from all other funds of the City and all of said sum, without any deductin� whatever, shall be delivered to the City Treasurer not more than ten (10) days after receipt of the same� or at such more frequent intervals as may from time to time be directed by the Mayor and City Council. Section 8. The City Treasurer shall receive all such revenues from the combined waterworks and sewera�e system and all other ftiuids and moneys incident to the operation of such system as the same may be delivered to him and deposit the same in a separate fund designated as the "Waterworks and Sewerage Fund of the City of Canton, and said Treasurer shall administer such fund in every respect in the manner provided by the provisions of the Illinois Municipal Code, effective July 1, 1961, and all laws amendatory thereof and supplementary thereto, and as provided in the ordinance here�ofore adopted on the 15th day of October, 1963, and authorizing the issuance of �1�825,000 Waterworks and Sewerage Revenue Bonds, Series of 1963 of said City. Section . The City Z`reasurer shall establish a p�oper system of accovnts and shall keep proper books, records and accounts in which complete and correct entries shall be made of all transactions relative to the combined waterworks and sewerage system, and at regular annual intervals he shall cause to be made an audit - 3 - � , • ' ' y �, • ` . . . , s . by an independent s�uditing concern of the books to show the receipts and disb urse- menta of the combined waterworks and sewerage system. ..: Section 10. That a copy of this ordinance, properly certified by the City Clerk, shall be filed in the office of the Recorder of Deeds of Fulton County, Illinois, and shall be deemed notice to all owners of real estate of their liability for service supplied to any user of the service of the combined waterworks and sewer- age system of said City on theix properties. Section 11. That Ordinance N�.unber 69 and Ordinance Nwnber 131, both as amended, be and are hereby repealed. Section 12. Al1 ordinances and parts of ordinances in conflict herewith are hereby repealed insofar as the conflicting portions thereof are concerned. Section 13.
