The Mayor called the meeting to order and directed the City Clerk to call
the roll. Upon roll being called the following Aldermen answered present:

and the following were absent:

The City Clerk presented and read in full the following ordinance:

ORDINANCE NUMBER 96
AN ORDINANCE of the City of Canton, Fulton
County, Illinois, requiring and regulating
the use of public sanitary sewers where same
are accessible and prohibiting the use of
cesspools, septic and sewage tanks and privies.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY,
ILLINOIS:
Section l. Use of public sanitary sewers required. 4lhere a public sani-
tary sewer is present in a street, alley easement or thoroughfare adjacent to the
premises occupied by a building, the liquid wastes from any plwnbing system in
said building shall be discharged into the public sanitary sewer unless inaccess-
ible thereto as determined by the City Council.
Section 2. Cesspools, septic or sewage tanks and privies. No cesspool,
septic or otl�er sewage tank, or privy shall be constructed on property to which
a public sanitary sewer is accessible.
The use of a11. cesspools, septic or other sewage tanks, and the privies
already constructed on property to which a public sanitary sewer is or becomes
accessible, shall be discontinued not later than one year after the passage and
publication of this Ordinance or after the public sanitary sewer becomes accessible.
Section 3. Public nuisances. Any cesspool, septic or sewage tank or
privy which shall be constructed or maintained on any property in violation of the
provis3.ons of this ordinance shall be and is hereby declared to be a public
nuisance and shall upon seven days' notice to the owner of said premises, be
abated. Should the owner fail or refuse to abate said nuisance within seven days
after receiving written notice thereof from the City of Canton, then the City of
Canton shall abate said nuisance and the owner of the premises shall be liable to
the said City of Canton for the costs and expenses of aba,ting same.
Section 4, Connections prohibited. The discharge from plutnbing fix-
tures, only, shall be connected to the public sanitary sewers of the City of
Canton. For the purposes of this Ordinance, the term "plumbing fixtures"

shall. be construed in accordance with the Illinois :�ate .Rlt�bing Code, and

shall specifically include basement floor drains.
The connection of footing tile, area drains, surface water inlets,
downspouts, yard or f�Pld drains or any other drainage facility which receives
ground-water seepage or collected surface water, to the public sanitary sewer
system is hereby prohibited.
Section 5. Violations and Penalties. Any person, corporation or firm,
violating any of the foregoing provisions , of this Ordinance shall upon conviction
be firred noi less than $5.00 nor more than $100.00 for each offense. Each day
that said provisions herein are violated shall be and constitute a separate
offense.
Section 6. Gi�neral Provisions. All ordinances or parts of ordinances
in conflict with the provisions of this Ordinance are hereby repealed.
This Ordinance shall be in full force and effect ten days after its
passage and filed in the office of the City Clerk this �rd day of Dee. �
