�RDINANCE N0. 106 .
WHEREAS, The City Council of the City of Canton, Illinois,
as heretofore approved plans and. specifications for the con-
struction, improvement and extension of the combined Waterworks
�nd Sewer System of the City of Canton, in accordance with plans
and specifications of the engineering firm heretofore employed
y the City of Canton, Illinois, now on file in the office of the
City Clerk of Canton, Illinois ;
AND, WH.�REAS, the engineering plans so adopted and filed,
as aforesaid, show that it is necessary for the proper construc-
tion, improvement and extension of said waterworks and sewer sys-
tem, that the following land, to wit :
The East One-half of the Northeast �,uarter of
Section Thirty-six C36) , Township Seven C7)
North, Range Four (4) East of the Fourth Prin-
cipa�. Meridian, in the Township of Canton,
County of Fulton, and State of Illinois ;
e acquired for the purpoae of constructing an oxidation lagoon
or pond thereon;
AND, WHE�A.S, by resolution adopted by the City Council of
the City of Canton on the '7th. day of April, 1g64, the Water and
Sewer Co�rimittee of said City of Canton was �iven power and author
ity to enter into negotiation with the owners of said property
for the purchase of said land;
ANT�, WHERr�AS, said Water and Sewer Committee did enter in-
to negotiation with the owners of said land for the purchase
thereof;
AND, WH�REAS, the said Water and Sewer Committee were un-
able to purchase said land at a reasonable price frcm the owners
thereof;
AND, '�'H�'REAS, the City Council of the City of Canton, Ill-
inois, now in regular session, is of the opinion that it is nec-
essary for the proper construction, improvement and extension of
said waterworks and sewer system that the above �escribed real
estate be secured for the purpose of constructing an oxidation
la�oon and plant on said property; Therefore
BE�. IT ORD9.INED BY TH.� CITY CGUNCIL OF THE CITY OF CANTON,
ILLTNOIS:
Section 1. That the City Attorney of the City of Canton,
e and he is hereby authorized and ordered to commence Condemna-
tion proceedings under the Eminent Domain Act of the State of I11
inois, and amendments thereto, in the State of Illinois Circuit
Court of the Ninth Judicial Circuit , County of Fulton, for the
purpose of acquiring said property, for the purposes hereinbefore
stated.
Section 2. This Ordinance shall be�Eome effective after
its passage by the City Council of Canton and approval of the
Mayor.
