ORDINANCE N0. -����
WHEREAS an Application to Vacate City Street has
been filed with the City of Canton, Illinois , to vacate that
part of Martin Avenue which lies immediately North of Lot 22 ,
hathan Jones Third Addition to Canton, Illinois , said area to
be vacated being more particularly described as follows :
Beginning at the Northeast corner of the
intersection of Avenue A and Martin Avenue
in said City of Canton, running thence t�est
136 feet , thence South 60 feet , thence East
136 feet, thence North 60 feet to the �ptl�ce
of beginning;
AND WHEREAS the abutting property owners have no
` objection to said vacation, and they believe that the public
interest will be served thereby;
AND WHEREAS the City Council of the City of Canton,
Illinois , has found and determined that the public interest
will be served by said vacation;
NOW, THEREFORE , BE IT ORDAINED F�Y THE CITY COliNCIL
OF THE CITY OF CANTON , ILLINOIS :
SECTION 1 . That part of Martin Avenue �ahich lies immediately
North of I.ot 2.2 , Nathan Jones Third Addition to
Canton, Illinois , described as follows , to wit :

SECTION 2 . Th�t t`,e legal title to sai�: r.r�.a �aac« ted shall
vest in the owners of ti�e 1�+��d �:��utting thereon
in t't�e same proportions and to the same extent
as though the street nad been dedicated by a
common law plat and as though the fee of the
street had been acquired by the owners as a
part of the land abutting on said street.
SECTION 3 . That said vacation shall be subject to such
rights of way and easements as nay exist in
favor of the City of Canton , Illinois , and any
public service corporation.

SECTION 4 . That within three years of the date of this.
Ordinance the abutting property owner shall
re-surface, with B-5 asphalt surfacing , that
part of Martin Avenue described as follows :
Beginning at the Northwest corner of the
intersection of Martin Avenue and West
Pine Street in the City of Canton, Illi-
nois , running thence North 159 feet , thence
East 60. 06 feet , thence South 159 feet,
thence West 60 . 06 feet to the place of be-
ginning.
That the re-surfacing as herein provided repre-
sents compensation to the City of Canton, Illi-
nois , for the vacating of said street , a,�.d said
re-surfacing shall be a contract obligation of
the abutting property owner. However , said re-
, � surfacing shall not be a condition precedent to
the validity of this Ordinance .
SECTION 5 . That the public interest will be subserved by
vacating that portion of Martin Avenue herein-
above described, and that the authoritq to vacate
is within the �urisdiction of the said City Coun-
cil.
PASSED BY THE CYTY COUNCIL OF CANTON, ILLINOIS , by an
�_�firmative vote of at least three-fourths of the aldermen au-
t;;orized by law to be elect�ed , and APPROVED by the riayor this
