FOR THE CURB CUT ON THE SOUTH SIDE OF FULTON SQUARE WHEREAS, Fulton Square, City of Canton and RER Enterprises, L.L.C., heretofore entered into an Agreement concerning development of the area known locally as Fulton Square; and, WHEREAS, said Agreement called for the opening of the curb on the South side of Locust Street between North Main Street and North First Avenue; and, WHEREAS, said Agreement provided that if the cost of the project exceeded $30,000.00 the overage was to be divided 1/3 to the City of Canton, 1/3 to Fulton Square and 1/3 to the development group; and, WHEREAS, the bids for said project have been received in the amount of $31,315.58 together with an estimated amount for engineering of $4,815.00. NOW, THEREFORE BE IT RESOLVED BY THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the City of Canton, through its officers be authorized to pay its 1/3 of the overage over $30,000.00 in order to perform in accordance with said development agreement. 2. That the Mayor and City Clerk on behalf of the City execute such documents and all other documents necessary for the carrying out said Agreement. 3. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 3rd day of November, 1998, upon a roll call vote as follows: AYES: Aldermen Hartford, Molleck, Phillips, Sarff, Meade, Nidiffer, May, Shores, NAYS: Nom, ABSENT: None AP VED: ~~ onald E.
