ORDINANCE AMENDING AN ORDINANCE (No. 401) PROVIDING FOR CERTAIN
PROCEEDINGS INVOLVING DISPOSITION OF REALTY SOUGHT TO BE ANNEXED
TO OR SOUGHT TO BE MODIFIED WITHIN THE CITY.
Be it ordained by the City Council of the City of Canton,
Illinois that Sections 2 and 31 respectively, of Ordinance No. 401,
heretofore enacted by this City, be and the same hereby are amended
to read as follows:
"Section 2: That in addition to procedures otherwise
required by law, any Petition or action which may
hereafter be contemplated with respect to the closing
of any alley, road or street within this City, whether
in whole or in part, shall be referred to the Planning
Commission by the City Council of this City for such
comment and recommendations to the City Council as
thereafter may be and prior to the time when final
action on such closing shall be considered by the
City Council of this City."
"Section 3: That, notwithstanding the foregoing
provision, the validity of any annexation or alley,
road or street closing shall not be impaired, in
any instance, if such there be, where the foregoing
procedures have not been followed, hereby meaning and
expressly declaring the foregoing provisions to be
procedural and not substantive."
This Ordinance shall be effective upon its passage by the
City Council and approval by the Mayor.
