HomeMy WebLinkAboutOrdinance #440 �' • i� _ ' � � - ORDINANCE N0. � � '� (AN ORDINANCE PROVIDING FOR THE SALE OF CITY OWNED REALTY GENERALLY LOCATED AT THE NORTHEAST CORNER OF THE 1NTERSECTION OF NORTH 6th AVENUE AND LOCUST STREET IN THE CITY OF CANTON, ILLINOIS . ) WHEREAS, the City of Canton, Illinois, by purchase, has heretofore acquired realty, legally described as hereinafter set forth, generally located at the Northeast Corner of the intersection of North Sixth Avenue and Locust Street in the City of Canton, Illinois ; and, WHEREAS, said realty was acquired for the purpose of thereon constructing and operating an auxiliary fire station of the City of Canton, Illinois ; and, WHEREAS, said realty has not , since its acquisition, been used by the City of Canton, Illinois for the intended purpose or any other purpose but now remains vacant, unoccupied, and unused ; and , WHEREAS, it has been determined by the corporate authorities of said City that the original intended purposes of said realty is no longer desirable or practicable and that said realty will not be used therefor ; and, WHEREAS, it has been further determined that said realty is not suitable for and will not be used for any corporate purposes of the City of Canton, Illinois ; and, WHEREAS, the corporate authorities of said City have determined that it is necessary and desirable in the furtherance of public interest that said realty ought now to be sold for purposes or usages restricted to residential use, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOZS AS FOLLOWS : l. That the realty owned by the City of Canton, Illinois, which is generally located at the northeast corner of the inter- section of North 6th Avenue and Locust Street in the City of Canton, Illinois, and which is legally described as follows , to-wit : Lots Numbered 1 and 2 in Block Number 3 in Kellogg and Babcock 's Addition to the City of Canton, Illinois, situated in the County of Fulton and State of Illinois, shall be sold for cash to the highest and best bidder therefor. 2. That said realty shall be sold for residential purposes only and that said realty shall be zoned, and the same hereby is, to the zoning classification of R-2 under the Zoning Ordinances of the City of Canton; Illinois . 3. That said realty shall be sold for cash, to be fully paid on or before 30 days following the opening, acceptance and . �r° " . • - ` � � . notification of successful bid. All interest of the City of Canton, Illinois in and to said realty shall be conveyed to the successful bidder by customary quitclaim deed and abstract of title thereto shall be furnished at expense of said City. Each bid shall be sealed and accompanied by a certified check (or equivalent thereto) of not less than 20% of the submitted bid (refundable to unsuccessful bidders) . The right to reject any bid is reserved. 4. That all bids for the purchase of said realty shall be opened and considered by the corporate authorities of said City at the regular meeting of the City Council of said City to be held in the City Council Room in the Canton City Building at 210 East Chestnut Street in the City of Canton, Illinois, commencing at 6 :30 P.M. on Tuesday, November 6, 1973 ; and , that all such bids must be filed with the City Clerk at said City Building not later than 5 :00 P.M. on said day. 5. That, prior to the sale of said realty, notice of this Ordinance and the proposal or determination herein contained to sell said realty shall be published by the Clerk of this City once each week for three successive weeks in a newspaper published in the City of Canton, Illinois, the first such publication to be printed not less than thirty days before the day hereinabove provided for the opening of bids for the purchase of said realty. Said notice shall contain an accurate description of said realty, shall state the purpose or purposes for which it is presently used and shall state the purpose for which it may be used and shall state at what regular meeting of the Canton City Council when the bids will be considered and opened. Said notice shall solicit or advertise for bids for the purpose of causing or bring about a sale of said realty. Said notice shall be in substantially the followng form: NOTICE (INVITATION FOR BIDS TO PURCHASE REALTY OWNED BY THE CITY OF CANTON, ILLINOIS) Notice is hereby given by the City of Canton, Illinois as follows : Pursuant to Ordinance passed by the City Council of the City of Canton, Illinois on October 2, 1973, bids are solicited and invited for the purchase of realty owned by the City of Canton, Illinois which is generally �tuated or located at the northeast corner of the intersection of North 6th Avenue and Locust Street in the City of Canton, Illinois and ` � , � . . which is legally described as follows , to-wit : Lots Numbered 1 and 2 in Block Number 3 in Kellogg and Babcock 's Addition to the City of Canton, Illinois, situated in the County of Fulton and State of Illinois. Said realty is not presently utilized for any purpose, is zoned R-� under the zoning ordinance of the City of Canton, Illinois and may be used by the purchaser thereof for residential purposes and nor�e other. Bids for the purchase of this realty must be sealed and submitted and filed with the City Clerk of the City of Canton, Illinois at the Canton City Building at 210 East Chestnut Street, Canton, Illinois not later than 5 :00 o 'clock P.M. on Tuesday, November 6, 1973 and sball be opened and considered by the Canton City Council at its regular meeting held that same day commencing at the hour of 6 :30 o 'clock P.M. in the Council Room of said City Building.
