F .lF..�;.��� ''� AN ORDINANCE REGULATING ENCROACt�fENTS ON PUBLIC RIGHT-OF-WAY IN THE `' , CITY OF CANTON ' FULTON COUNTY � ILLINOIS I iWHEREAS, the City of Canton, hereinafter known as the CITY, and the State , of Illinois, acting by and through its Department of Transportation, Division � of Highways� hereinafter known as the STATE, have entered into an agreement relative to the improvement of portions of Main Street and West Locust Street� known as SBI Routes 78 and 9, Section (135 W) RS and (412) RS, and WHEREAS, in order to facilitate the said improvement, it is necessary for the . CITY to adopt an ordinance regulating encroachments on the right-of-way for said improvement in accordance with the following definitions: Roadway Right-of-�day is defined as those areas existing or acquired by dedication or by fee simple for highway purposes, also areas ac- ' quired by temporary easement during the time the easement is in effect. Encroachment is defined as any bui?,ding, fence, sign, or any other structure or object of any kind (with the exception of utilities and public road signs) which is placed, located, or maintained in, . on, under, or over any portion of the roadway right-of-way. Permissible Encroachment is defined as any encroac�unent which, in the opinion of the STATE, does not impair the free and safe flow of traffic on the highway. These permissible encroachments shall be allowed to remain by a Revokable Permit. WHEREAS, representatfves of the CITY and STATE have mutually determined the disposition of encroachments. � NOW, THEREFORE, be it ordained by the City of Canton, Fulton County, Illinois: Section �I It shall be unlawful for any person, firm, or corporation to erect or cause to be erected, to retain or cause to be retained any encroachments (hereinabove defined), except as provided in Section II, within the limits of the road�aay right-of-way. Section II Permissible encroachments (hereinabove described) shall be allowed to remain by the use of a Revokable Permit obtained by the CITY and submitted to the STATE. Permissible encroachments shall be classified as such by the STATE. Section III This Ordinance is intended to and shall be in addition to all other ordinances, rules, and regulations concerning encroachments and shall not be construed as repealing or rescinding any other ordinances or part of any ordinances unless in direct conflict therewith. , , , � R ' .. - '..'...<:a,:s::.. _... Section IV Any person, firm, or corporation violating this Ordinance shall be fined not less Chan Five Dollars, nor more thar�'''o Hundred Dollars for each offense; and a separate offense shall be deemed co�nitted for each and every day during which a violation continues or exists.
