AN ORDINANCE AMENDING SECTION 3-8-11 (INTOXICATING LIQUORS: BONDS REQUIRED)
OF THE CANTON MUNICIPAL CODE
WHEREAS, Section 3-8-11 (Intoxicating Liquors: Bonds Required) of the Canton Municipal Code
currently states "Before any person shall be issued a license, he shall be required to furnish a good and
sufficient bond with sureties to be approved by the local liquor control commission in the penal sum of five
hundred dollars ($500.00) payable to the city conditioned upon the said licensee observing all the requirements
of this chapter and the laws of the state."
WHEREAS, other methods of surety may be available at reduced or no cost to the licensee, and
WHEREAS, other methods of surety may result in the same effect as the bond requirement, and
WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and in the best
interests of the citizens of Canton, Illinois to amend Section 3-8-11 (Intoxicating Liquors: Bonds Required) of
the Canton Municipal Code to allow for other methods of surety as approved by the local liquor control
commission, and
WHEREAS, the City Council has made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, Fulton County, Illinois, as follows:
That Section 3-8-10 (Intoxicating Liquors: Bonds Required) b1-20 (Licenses: Criminal
Background Checks) of the Canton Municipal Code be amended to read as follows:
Before any person shall be issued a license, he shall be required to furnish a good and sufficient bond
with sureties to be approved by the local liquor control commission in the penal sum of five hundred
dollars ($500.00) payable to the city conditioned upon the said licensee observing all requirements of
this chapter and the laws of the state. As an alternative to the bond and upon approval by the local
liquor control commission, the licensee can also post as surety: cash, postal money order, draft or
cashier's check in the sum of five hundred dollars ($500.00) payable to the city conditioned upon the
said licensee observing all requirements of this chapter and the laws of the state.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 3rd
day of June , 2008 upon a roll call vote as follows:
AYES: Aldermen Lewis, Strandberg, Nidiffer, West, Sarff, Berardi, Schenck..
NAYS: None
ABSENT: Orie due to Alderman Meade becoming the mayor .
