ORDINANCE N0. ����
AN ORDINANCE VACATING A PART OF NORTH MAIN STREET
WITHIN THE CITY OF CANTON, ILLINOIS
WHEREAS, Illinois Revised Statutes, Chapter 24, Section 11 -
91 - 1, et. seq. , provides that the corporate authorities of any
municipality in the State of Illinois may vacate streets or alleys
or parts thereof by ordinance when it is determined that the public
interest will be subserved by vacating such streets, alleys, or
parts thereof; and
WHEREAS, the corporate authorities of the City of Canton,
Illinois have determined that the public interest will be sub-
served by vacating a part of North Main Street located within
the City of Canton, Illinois, more particularly bounded and
described as follows:
Com�nencing at the Southeast corner of Lot 19
in Jones' First Addition to Canton, Fulton
County, Illinois; thence bearing North, a
distance of 23.25 ft. along the East line of
said Lot 19 to a point; thence bearing East,
a distance of 44.55 ft. to a point on the
center line of Main Street; thence bearing
South a distance of 114.87 ft. along the
center line of said Main Street to a point;
thence bearing West, a distance of 44.55 ft.
to the Southeast corner of Lot 22 in said
Addition; thence bearing North a distance
of 91.62 ft. along East line of said Lot 22
to the point of beginning; containing 0.117
acres.
The above described part of North Main Street within
the City of Canton, Illinois, to be vacated is shown on the
� plat attached �hereto and made a part hereof entitled "Vacation

WHEREAS, the corporate authorities of the City of Canton,
Illinois, have previously by Ordinance No. 523, passed and
approved on the 7th day of January, 1976, adopted a compre-
hensive plan for parts of the central business district of
the City of Canton, I1linois, and
WNEREAS, the vacation of the above described part of
North Main Street is in all respects in conformitq with the
comprehensive plan and its ob�ectives, and
WHEREAS, the above described part of North Main Street
and the properties contiguous to said described part of North
Main Street are wholly within the corporate limits of the City
of Canton, Illinois, and
WHEREAS , the corporate authorities determine that the
vacation of the above described part of North Main 3treet
constitutes a public use and is in the best public interest
in that the public will be relieved from the further burden
and responsibility of maintaining such part of North Main Street.
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Canton, Illinois, that the following described part
of North Main Street be and the same is hereby vacated as pro-
vided by law:
Commencing at the Southeast corner of Lot 19
in Jones' First Addition to Canton, Fulton
County, Illinois; thence bearing North, a
distance of 23.25 ft. along the East liae of

to the Southeast corner of Lot 22 in said

The above described part of North Main Street herein
vacated is shown on the plat attached hereto and made a part
hereof entitled "Vacation Plat".
BE IT FURTHER ORDAINED that the City of Canton, Illinois,
retains the right to maintain, operate, repair and replace, by
itself or by any licensee or a holder of a franchise from the
City, any and all wires, pipes, conduits, sewer mains, water
mains, or any other facility or equipment for the maintenance
or operation of any utility now located beneath the surface of
the street herein vacated.
BE IT FURTHER ORDAINED that in the event any of the afore-
mentioned utilities are removed or are no longer necessary to be
preserved pursuant to consent by the corporate authorities of
the Citq of Canton, I1linois and the utility company or compa-
nies operating such utilities, then and in that event the right
of the City of Canton, Illinois to maintain, operate, repair and
replace said utilities as above provided shall be terminated
with respect to the premises herein vacated.
BE IT FURTHER ORDAINED that the City Clerk of the City

of Canton, Illinois be and is hereby directed to cause a certi-
fied copy of the within plat attached hereto to be recorded in
the Office of the Recorder of Deeds of Fulton County.
BE IT FURTHER ORDAINED that this Ordinance shall be in
full force and effect from and after its passage and approval
as provided by law.

Hurst, Sepich, Horr, Edwards, Cook, Peak, Spencer, Yerbic, Conrad, and
Kovachevich.

None
and that the foregoing members present and absent constitute
all of the members of the City Council holding office on the
