A RESOLUTION TO MODIFY THE FACILITY PLANNING AREA
ON EAST LINN STREET
WHEREAS, the City of Canton is proposing to provide sanitary sewer service to
a motel now under construction on East Linn Street in the City of Canton, Illinois; and,
WHEREAS, the site is outside of the Facility Planning Area of the City of
Canton; and,
WHEREAS, it is necessary to expand the City's Facility Planning Area before the
Illinois Environmental Protection Agency will grant a permit for the motel being
constructed to connect to the sanitary sewer system of the City of Canton; and,
WHEREAS, the City, once an application to amend is filed, must publish public
notice of the amendment of its Facility Planning Area, (FPA), to all government bodies
within 1.5 miles of the FPA boundary to be followed by a 30-day public comment period;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Facility Planning Area of the City of Canton shall be expanded to
include the motel site being approximately 300 feet by 700 feet. Notice shall be published
in accordance with the law and administrative rules and regulations.
2. That this Resolution shall be in full force and effect immediately upon its
passage by the City Council of the City of Canton, Fulton County, Illinois.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting this 3rd day of February, 1998, upon a roll call vote as follows:
AYES: Aldermen Hartford, Molleck, Phillips, Sarff,
Meade, Nidiffer, May, Shores.
NAYS: None .
ABSENT: None .

'SUBJECT: Facility Planning Area (FPA) and Mark Twain Motel
The city is proposing to provide sanitary sewer service to the
new motel on East Linn St. However, the site is outside the city's
FPA. .Before the Illinois Environmental Protection Agency (IEPA) will
grant a permit for the motel to connect to the sanitary sewer system,
the FPA must be expanded to include the site. Therefore, the city
must be on record that it wants to do this.
The city, when it accepted grant funds from the federal
government, agreed not to provide sewer service outside of the FPA.
The IEPA is denying a permit to construct the 8-inch sanitary
sewer extension until the FPA is expanded.
' The FPA is a part of the federal Water Qualitv Mana4ement (WQM)
Plan, that states as follows: "In addition to the assurance of sound
economical and environmental decision making, the WQM Plan is also
intended to serve as a tool to protect the Federal and State
investment in pollution control facilities." .
I am preparing the IEPA Amendment Application Package, and I
will be prepared to submit it next week. We then must issue public
notice of the amendment to all government bodies within 1.5 miles of
the FPA boundary, and publish a notice in the newspaper, with a
30-day public comment period.
The boundary modification that I am proposing will include only
the motel site, approximately 300 ft. by 700 ft. I am not interested
in expanding further east, because the area has been strip-mined, the
environmental assessment will take more time and expense, and there
does not appear to be any interest in constructing anything there
now.
Please provide a motion to modify the FPA boundary.
