HomeMy WebLinkAboutOrdinance #3064 ORDINANCE NO 3064 AN ORDINANCE AMENDING TITLE 7 (HEATLH & SANITATION) CHAPTER 1 (NUISANCES) SECTION 4 (DRUG PARAPHERNALIA CONTROL) WHEREAS, the Public Safety & Traffic Committee has determined that it is in the best interest of the citizens of Canton, Illinois, to amend Title 7 (Health & Sanitation) Chapter 1 (Nuisances) Section 4 (Drug Paraphernalia Control) to allow violations for the possession of drug paraphernalia to be settled pursuant to ; and WHEREAS, the City of Canton is desirous of exercising its authority to settle such ordinance violations without going to court; and WHEREAS, in furtherance of its statutory powers to amend the Municipal Code for the City of Canton, the City Council and the Mayor, have determined that it is the best interest of the City to regulate the possession of drug paraphernalia. NOW THEREFORE, BE IT ORDAINED, by the Mayor and the City Council for the city of Canton, Illinois, as follows: 1. The City of Canton Municipal Code, Title 7 entitled "Health & Sanitation" is amended by amending Chapter 1 entitled "Nuisances" Section 4 entitled "Drug Paraphernalia Control"to settle violations of such ordinance. 2. That the Amendment to the City of Canton Municipal Code under Title 7 Chapter 1 Section 4 shall read as follows: 7-1-4-1(a): POSSESSION OF DRUG PARAPHERNALIA: It shall be unlawful and a violation of this Chapter for any person to possess drug paraphernalia. 7-1-4-1(b): PENALTY: Violation of any provisions of this Section of this Chapter shall be subject to a fine of not less than $300 and not more than $750. Settlement of such violations may be done in accordance with the provisions as set forth in the section of this Code that allows for the settlement of citations written for certain Code violations.
