A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF

WHEREAS, the City Council of the City of Canton, Illinois has reviewed the
terms of the Agreement, a copy of which is attached hereto and made a part hereof as
Exhibit A; and,
WHEREAS, the City Council of the City of Canton= Illinois has determined that it
is in the best interest of the City of Canton to approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE. CITY COUNCIL OF
THE CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Agreement which is attached hereto and made a part hereof as Exhibit
A, is hereby approved, said agreement to be subject to and effective pursuant to the terms
and conditions sei forth thgrein.
2. That the Mayor of the City of Canton, Illinois is hereby authorized and directed
to execute and deliver said Agreement on behalf of the City of Canton.
3. That this Resolution shall be in full force and effect immediately upon its
passage by the City Council of the City of Canton, Fulton County, Illinois and approval by
the Mayor thereof.

regular meeting this 6th day of, 1999, upon a roll call vote as follows:

AGREEMENT FOR SPECIAL TAP FEES
This agreement is made at Canton, Illinois on the date shown at the end hereof and
is by and between the City of Canton, an Illinois municipal corporation ("City") and
MARCUS L. BURKHEAD and JEAN M. BURKHEAD and sets forth the understanding
of the parties pertaining to tap on fees for the extension of a water line.
Whereas MARCUS L. BURKHEAD and JEAN M. BURKHEAD have privately
caused an extension of the Canton municipal water system to be made by a 4" water line
to their residence in Venovich Estates:. near . Canxon Lake_ and. said line_ was_ finauc~d in
whole by MARCUS L. BURKHEAD and JEAN M. BURKHEAD at a cost of $7,840.73
as shown on Exhibit A.
Whereas, the City Council of the City has agreed to waive the requirement of
Section 8-21-1 of the Canton Municipal Code that a written agreement shall be in
existence and in the City's files before any_construction starts;
NOW, THEREFORE it is agreed that hereafter, any person or entity desiring to
connect to the 4 inch water line herein described before connecting shall pay to the City of
Canton a tappage fee in addition to the normal tappage fee based upon the $7,840.73 in
cost incurred by MARCUS L. BURKHEAD and JEAN M. BURKHEAD to construct the
Jt~rger line before financial assistance from the City.
Payments shall be made to the City Treasurer for reimbursement as hereafter
provided.
This agreement shall be for a period of ten (10) years from the issuance of the
Illinois E.P.A. permit for the line.
Reimbursement shall be calculated as follows: Each person to tap on in addition to
MARCUS L. BURKHEAD and JEAN M. BURKHEAD shall pay $1,000.00 to the City
of Canton. The money so received by the City shall be reimbursed to MARCUS L.
BURKHEAD and JEAN M. BURKHEAD up to a total of $6,840.73, so that if all
properties in the area are sold, each will share equally in the extension cost.
Each year the principal amount may be adjusted by the Consumer Price Index
(CPI). Any CPI increases shall go to the City of Canton for maintenance and
adminicrr t;on.
In witness the. parties have executed this agreement on this day of March,
1999.
