AN ORDINANCE AMENDING TITLE 7 (HEATLH & SANITATION)
CHAPTER 1 (NUISANCES) SECTION 3 (CONTROLLED SUBSTANCES)
WHEREAS, the Public Safety & Traffic Committee has determined that it is in the best
interest of the citizens of Canton, Illinois, to amend Title 7 (Health & Sanitation) Chapter 1
(Nuisances) Section 3 (Controlled Substances) to prohibit the possession of cannabis; and
WHEREAS, the City of Canton is desirous of exercising its authority to regulate
controlled substances, including cannabis; and
WHEREAS, in furtherance of its statutory powers to amend the Municipal Code for the
City of Canton, the City Council, and the Mayor, have determined that it is the best interest of
the City to regulate the controlled substances of cannabis.
NOW THEREFORE, BE IT ORDAINED, by the Mayor and the City Council for the city of
Canton, Illinois, as follows:
1. The City of Canton Municipal Code, Title 7 entitled "Health & Sanitation" is amended
by amending Chapter 1 entitled "Nuisances" Section 3 entitled "Controlled Substances"
to prohibit the possession of cannabis.
2. That the Amendment to the City of Canton Municipal Code under Title 7 Chapter 1
Section 3 shall read as follows:
7-1-3-1(a): POSSESSION OF CANNABIS: It shall be unlawful and a violation of this
Chapter for any person to possess cannabis, as defined in the Illinois Cannabis Control Act, 720
ILCS 550/1 et seq, in the amount less than 10 grams.
7-1-3-1(b): PENALTY: Violation of any provisions of this Section of this Chapter shall be
subject to a fine of not less than $300 and not more than $750. Settlement of such violations
may be done in accordance with the provisions as set forth in the General Penalty section of this
Code.
PASSED by the City Council of the City of Canton, Illinois and approved by the Mayor
thereof this 18t" day of February 2014, upon a roll call vote as follows:
AYES: Aldermen West, Putrich, Jim Nelson, Pickel, Justin Nelson, Ellis,
Lovell, Pasley
