RESOLUTION NO. 3546
A RESOLUTION DIRECTING DEMOLITION OF IMPROVEMENTS TO REAL
PROPERTY LOCATED AT 449 WEST LOCUST STREET, CANTON, ILLINOIS
WHEREAS, that by reason of recommendations by the Building Officer for the
City of Canton, it has been made to appear that the improvements at 449 W. Locust
Street, Canton, Illinois, and more specifically described as follows:
A part of Lot Five (5) in French's Addition to Canton, described as
follows: Commencing at the Southwest Corner of Lot 92 in Hipple's
Subdivision of Lots 4, 7, 8 and 15 in French's Addition to Canton, Illinois
and running thence North 165 feet more or less, thence West 82 feet,
thence South 165 feet more or less to North line West Locust Street,
thence East 82 feet to the place of beginning, situated in Fulton County,
Illinois,
is in a dangerous and unsafe condition and that said real estate is owned by Larry Jo
Smith.
WHEREAS, 65 ILCS 5/11-31-1 et seq., Illinois Compiled Statutes empowers
municipalities to demolish, repair and cause the demolition or repair of dangerous and
unsafe buildings; and further empowers municipalities to apply to the Circuit Court for an
Order to demolish, obtain a personal judgment for costs of demolition and the legal
action, and obtain a lien on said premises and to foreclose on same; and,
WHEREAS, the 15 day statutory notice has previously been given by City staff
pursuant to prior instructions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Canton, Fulton County, Illinois that the three story building located on the premises
described above is hereby declared to be dangerous and unsafe within the meaning of the
Statutes set forth in 65 ILCS 5/11-31-1 et seq., Illinois Compiled Statutes; and,
BE IT FURTHER RESOLVED that the Canton City Attorney be and is hereby
authorized and directed to apply on behalf of the City of Canton to the Circuit Court of

the Ninth Judicial Circuit of Fulton County, Illinois, for an Order authorizing the City to
demolish said building, to obtain judgment for the costs of every kind, and to attach a lien
thereto and to foreclose the same.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting this 20th day of November , 2000, upon a roll call vote as follows:
