ORDINANCE NO. 3049
An Ordinance annexing certain property of Betty M. Hefley at 21 Marlee Drive, Canton, Fulton,
Illinois, 61520 ("Property")
WHEREAS, the Property described on Exhibit A, which is attached hereto and made a
part hereof by reference ("Property"), is not located within the corporate limits of the City of
Canton, but is located in the County of Fulton and State of Illinois; and
WHEREAS, Betty M. Hefley has filed a Petition for Annexation seeking to annex the
Property located at 21 Marlee Drive, Canton, Illinois, PIN: 09-08-15-202-004, into the city
limits of Canton, Illinois.
WHEREAS, the Property is contiguous and surrounded to the City of Canton on both
sides of it, including 20 and 22 Marlee Drive, Canton, Illinois.
WHEREAS, Notice was given to the Trustees of the Copperas Creek Fire Protection
District, in accordance with 65 ILCS 5/7-1-1; and
WHEREAS, Notice was published in the Daily Ledger, a secular newspaper of general
circulation in the City of Canton and County of Fulton, Hefley's Petition for Annexation in
accordance with 65 ILCS 5/7-1-2(b); and
WHEREAS, on December 9, 2013, the Joint Planning and Zoning Commission of the
City of Canton, Illinois, met pursuant to notice as required by law and held a public hearing
concerning the Petitioner's request to annex the Property to the City of and at said public
hearing, there were no objectors present and thereafter, the Joint Planning and Zoning
Commission unanimously recommended to the City Council of the City of Canton, Illinois, the
annexation of 21 Marlee Drive.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, ILLINOIS, A MUNICIPAL CORPORATION:
1. The Property described on Exhibit A, attached hereto and made a part hereof by
reference, shall be and the same is hereby annexed to the City of Canton.
2. A certified copy of this Ordinance annexing the Property, together with an accurate
map of the annexed territory, shall be recorded with the Recorder of Deeds of Fulton
County, Illinois, and filed with the County Clerk of Fulton County, Illinois, in
accordance with 65 ILCS 5/7-1-8.
3. That the Mayor of the City of Canton, Illinois, shall be and he is hereby authorized to
affix his signature as the Mayor of said City to this Ordinance and the City Clerk of
the City of Canton, Illinois, shall be and she is hereby authorized to attest such
signature thereto.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting this 7th day of January 2014 upon a roll call vote as follows:
