WITNESS my hand and the Corporate Seal of the City of Canton, Illinois this 17th day of December 2013. . �C� Di avley-Rock City Clerk (SEAL) ORDINANCE #3045 ORDINANCE PROVIDING FOR THE EXTENSION OF THE CITY OF CANTON/FULTON COUNTY ENTERPRISE ZONE WHEREAS, on December 27, 1982, the City Council (the "City Council") of the City of Canton, Illinois (the "City"), pursuant to the Illinois Enterprise Zone Act (the "Act"), did adopt that certain Ordinance Initiating Enterprise Zone describing and designating an area located partially within the City, the City of Canton Illinois ("City") and the County of Fulton, Illinois ("County") as an Enterprise Zone (including as later supplemented and amended, the "Initiating Ordinance"); and WHEREAS, at the time of adoption of the Initiating Ordinance, the Enterprise Zone Act then in effect limited the life of the Enterprise Zone to thirty (30) years, or until December 31, 2013 and WHEREAS, on December 3, 2002, the City Council did approve that certain Resolution Authorizing Execution of Cooperation Agreement, approving the execution by the City of the Enterprise Zone Cooperation Agreement of December 3, 2002 (including as later supplemented and amended, the "Cooperation Agreement"); and WHEREAS, the area described and designated by the Ordinance, including as supplemented and amended by the Ordinance, has been certified by the Department of Commerce and Community Affairs, or its successor (the "Department"), as the Canton/Fulton County Enterprise Zone, in accordance with the Act (the "Enterprise Zone"); and WHEREAS, the City Council has previously amended and supplemented the Ordinance, the Cooperation Agreement and the Enterprise Zone, and approval of such amendments was made by the Department by certification of the Ordinance, Cooperation Agreement and Enterprise Zone as so amended and supplemented; and WHEREAS, through such an amendment, previously adopted by the City and Fulton County and certified by the Department on June 30, 1983, the City and Fulton County continued their participation in the Enterprise Zone through December 31, 2013; and WHEREAS, by Public Act 97-905, the Illinois General Assembly amended the Enterprise Zone Act, at 20 ILCS 655/5.3(c), to provide, inter alia, that Each Enterprise Zone in existence on the effective date of this amendatory Act of the 97th General Assembly that is scheduled to expire before July 1, 2016 will have its termination date extended until July 1, 2016. and; WHEREAS,the City Council now finds it necessary and desirable to further amend the Ordinance and Cooperation Agreement to incorporate the provisions P.A. 97-905; NOW, THEREFORE, be it ordained by the City Council of the City of Canton, Illinois, as follows: Section 1. All the recitals contained in the preambles to this ordinance are full, true and correct and the City Council does hereby incorporate them into this ordinance by this reference. Section 2. Notwithstanding anything to the contrary in the Initiating Ordinance and Cooperation Agreement and any prior amendments thereto, the terms of each are hereby amended to provide that the termination date of the Enterprise Zone is July 1, 2016. Section 3. The Mayor of the City of Canton shall have, and is hereby given authority to execute a codicil to the Amended and Restated Cooperation Agreement among the City and Fulton County, reflecting the terms of this Ordinance. Section 4. Except to the extent amended hereby, all actions taken with respect to the Enterprise Zone prior to the date of this ordinance, including all provisions, agreements, stipulations, rights, obligations and duties set forth in the Ordinance, as previously supplemented and amended, and the Cooperation Agreement, as previously supplemented and amended, are hereby ratified, confirmed, and incorporated herein as fully as if set forth in their entirety. Section 5. The Enterprise Zone Administrator is hereby authorized and directed to deliver a certified copy of this Ordinance to the State of Illinois pursuant to the Act to amend the Ordinance, the Cooperation Agreement and the Enterprise Zone as set forth herein. Section 6. If any section, paragraph, clause or provision of this ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this. Section 7. This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
