HomeMy WebLinkAboutOrdinance # 1925ORDINANCE NO. 1925 AN ORDINANCE AMENDING ORDINANCE NO. 1917 AS ADOPTED BY THE CANTON CITY COUNCIL ON DECEMBER 18, 2007. WHEREAS, on December 18, 2007 the Canton City Council adopted Ordinance No. 1917; and WHEREAS, Ordinance No. 1917 approved the Implementation Plan for Golf View Villas Planned Unit Development; and WHEREAS, Ordinance No. 1917 authorized the City of Canton to install the necessary materials and equipment to provide water and sewer to Lots 1 through 24 at a total expense to the City of fifty-seven thousand, six hundred seventy-two dollars ($57,672.00), broken down as follows: Water Service Material Cost = $7,000 Labor Cost = $6,900 Total = 13 900 Sewer Service Material Cost = $23,772 Local Contractor = $20,000 Total = 43 772 TOTAL = ~5~7 Said cost estimate was premised on the City purchasing the necessary materials and installing water service from the existing water main located on the L.D. Barnard property to the Golf View Villas property line and included the City retaining and paying a local contractor for sewer excavation and purchasing necessary materials to install sewer service; and WHEREAS, after Ordinance No. 1917 was passed, it was subsequently determined that the existing easement for the water main on the L.D. Barnard property was not sufficient to allow for water service to be installed from the existing main; and WHEREAS, it was determined that an additional water line easement of approximately eight (8') feet was necessary to complete the water service; and WHEREAS, L.D. Barnard requested seventy-thousand dollars ($70,000.00) as compensation for the proposed eight foot (8') water line easement; and WHEREAS, the cost of the proposed easement would increase the total original project costs from fifty-seven thousand, six hundred seventy-two dollars ($57,672.00) to one hundred twenty seven thousand, six hundred seventy two dollars ($127,672.00) broken down as follows: Water Service Material Cost = $7,000 Labor Cost = $6,900 Additional Easement = $70, 000 Total = 83 900 Sewer Service Material Cost = $23,772 Local Contractor = $20,000 Total = 43 772 TOTAL = ~L'~ Said cost estimate is premised on the City purchasing the necessary materials and installing water service from the existing water main located on the L.D. Barnard property to the Golf View Villas property line and included the City retaining and paying a local contractor for sewer excavation and purchasing necessary materials to install sewer service; and WHEREAS, the City has proposed that, as an alternative, a six inch (6") water main could be installed along the south side of the Golf View Villas property lines in an existing ten foot (10') utility easement for a cost of twenty six thousand, eight hundred dollars ($26,800); and WHEREAS, the City has proposed that the alternative approach would have no effect on the sewer costs; and; WHEREAS, the alternative would increase the total project cost from fifty-seven thousand, six hundred seventy-two dollars ($57,672.00) to seventy thousand, five hundred seventy two dollars ($70,572.00), broken down as follows: Water Service Material Cost = $18,900 Labor Cost = $6,900 Engineering (EPA permitting) _ $1,000 Total = 26 800 Sewer Service Material Cost = $23,772 Local Contractor = $20,000 Total = 43 772 TOTAL = X0,572 2 Said cost estimate is premised on the City purchasing the necessary materials and installing water service from the existing water main located along Fourth Avenue on the south side of the Golf View Villas property lines in an existing ten foot (10') utility easement and paying a local contractor for sewer excavation and purchasing necessary materials to install sewer service; and WHEREAS, the City's financial obligation to the project is limited to fifty-seven thousand, six hundred seventy-two dollars ($57,672.00); and WHEREAS, the Canton County Club Real Estate, LLC, as developer of Golf View Villas Planned Unit Development, is obligated to incur the additional, unforeseen, costs for installing water and sewer service; and WHEREAS, the Public Works Committee has determined that it is necessary and in the best interests of the citizens of Canton, Illinois to amend Ordinance No. 1917 by requiring the additional, unforeseen, costs of installing water and sewer service be paid by the Canton County Club Real Estate, LLC; and WHEREAS, the City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the Canton County Club Real Estate, LLC, as developer of Golf View Villas Planned Unit Development must pay for the additional, unforeseen, costs for installing water and sewer service; and 2. That the Canton Country Club Real Estate, LLC will advise the Canton City Council, Public Works Director and City Engineer, in writing, of their choice to pursue the original plan plus additional cost of seventy-thousand dollars ($70,000.00) or the alternative plan, at an additional cost of twelve thousand, nine hundred dollars ($12,900) within ten business days of the passage of this ordinance. 3. That the Canton Country Club Real Estate, LLC will pay the City the additional costs, directly, at least ten business days prior to the commencement of the project. The City will undertake no obligation or make no representation or warranty as to water and sewer service if said payment is not made. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 18th day of March , 2008 upon a roll call vote as follows: AYES: Aldermen Schenck, Berardi , Sarf f , Gles t , Nidif f er , Meade , Strandberg , Lewis. 3 NAYS: None .
