AN ORDINANCE AMENDING SECTION 3-8-4 (CLASSES OF LICENSES) OF THE
CANTON MUNICIPAL CODE
WHEREAS, Section 3-8-4 (classes of LicensesJ Subsection (AJ2(bJ currently states,
"The supplemental license requested shall not be issued for any location in a
residential section of the City, as defined in Section 10-4-1 of this code. No live
enterfainment shall be permitted outside except live music. No music (recorded
or IiveJ or any other broadcast, including public address, shall be made at an
unreasonable level and shall conform with City Ordinances including prohibition
of noise or similar nuisance. All outside enterfainment or music shall be limited to
the hovrs of eleven o'clock (1 1:00J A.M. to ten o'clock (10:00J P.M. on Friday
and Saturday. Outside enterfainment or music shall be prohibited on Sunday."
"Only holders of a class A, B, C, D, or G license may apply for such
supplemental license. If a supplemental license is granted to a class B license
holder, the licensee shall continue to maintain its primary business as a
restaurant pursuant to Section 3-8-2 of this chapter. Such license may be
revoked at any time should the above rules not be followed." (Ord. 2061, 12-20-
201 1 J, and;
WHEREAS, the City has received a request from downtown tavern owners
and other owners of valid liquor licenses to extend the hours for outside
~ enterfainment to ~~i~#s-1 1:00 P.M. on Friday night and Saturday night, and;
Whereas, the City staff would like to accommodate the tavern owners
with valid liquor licenses to encovrage downtown development while at the
same time balancing the interest of those in the community against excessive
noise, and;
Whereas, the City Council has determined that it is in the best interests of
the City to modify the ordinance by extending the time for outside
~ enterfainment from 10:00 P.M. in the evening until 88-?~?iel~+~##11:00 P.M.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL, OF THE CITY OF
CANTON, Fulton County, Illinois, as follows:
1. That the foregoing recitals of fact are found to be true.
2. That Section 3-8-4 (Classes of LicensesJ Subsecfiion (AJ Class A,
Tavern License (2J Subclass A(bJ of the Canton Municipal Code
shall hereby be amended to read as follows:
(bJ "The supplemental license requested shall not be issued for any
location in a residential section of the City, as defined in Section 10-
4-1 of this Code. No live enterfainment shall be permitted outside
except live music. No music (recorded or IiveJ or any other
broadcast, including public address, shall be made at an
unreasonable level and shall conform with the City Ordinances
including prohibition of noise or similar nuisance. All outside
enterfainment or music shall be limited to the hours of eleven
o'clock (1 1:00J A.M. Friday to #~a~°'~~;~-~leven o'clock (1 ~1:00J r4P.M.
~a#~ela-~Friday and eleven o'clock A.M. Saturday to ~ri: °'~~~leven
o'clock (-1-~1 1:OOJ ~P.M. ~ae~ei-y~Saturdav morning. Any extensions
of time shall be by special permit request to be approved by the
City Council. Outside enterfainment or music shall be prohibited on
Sunday."

3. That upon passage of this Amendment, the City Clerk shall be
instructed to forward to the codifiers of our Municipal Ordinance
the said Ordinance Amendment for insertion in its proper place in
each copy of this Code within thirfy (30J days from the date of its
final passage.
PASSED by the City Council of the City of Canton, Fulton Covnty, Illinois, at
a regular meeting this 6th day of August, 2013 upon a roll call vote as
follows:

NAYS: None
