A RESOLUTION APPROVING DEMOLITION OF
IMPROVEMENTS TO REAL PROPERTY LOCATED AT 102 EAST
ELM STREET, CANTON, ILLINOIS
WHEREAS, that by reason of recommendations of Phillips and
Associates, Inc. it has been made to appear that the improvements at 102
East Elm Street, Canton, Illinois, and more specifically described as follows:
The West 42 Feet of even width of Lot 35 in Jones' Second Addition
to the City of Canton. Fulton County, Illinois
PIN: 09-08-27-436-001
Was in a dangerous and unsafe condition and emergency measures were
necessary to have building improvements demolished and that said real
estate owned by Hidden Treasures Inc.
WHEREAS, 65 ILCS 5/11-31-1 et seq., Illinois Compiled Statutes
empowers municipalities to demolish, repair and cause the demolition or
repair of dangerous and unsafe buildings; and further empowers
municipalities to apply to the Circuit Court for an Order to demolish, obtain
a personal judgment for costs of demolition and the legal action, and obtain
a lien on said premises and to foreclose on same; and,
WHEREAS, the notice was given to Hidden Treasures Inc. and they
Hidden Treasures consented to the emergency demolition.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Canton, Fulton county, Illinois that the building (s) located on the
premises described above was in a dangerous and unsafe condition within
the meaning of the Statutes set forth in 65 ILCS 5/11-31-1 et seq., Illinois
Compiled Statutes; and, in and that emergency demolition was required.
BE IT FURTHER RESOLVED that the Canton City Attorney be
and he is hereby authorized and directed to apply on behalf of the City of
Canton to The Circuit Court of the Ninth Judicial Circuit of Fulton County,
Illinois, for an Order authorizing the City to demolish said building, to
obtain judgment for the costs of every kind, and to attach a lien thereto and
to foreclose the same.
PASSED by the City Council of the City of Canton, Fulton County,
Illinois at the regular meeting this 5th day of June, 2001, upon a roll call
vote as follows:
