ORDINANCE NO. 1956
AN ORDINANCE VACATING MERCANTILE COURT IN THE CITY OF CANTON,
FULTON COUNTY, ILLINOIS.
WHEREAS, Section 11-91-1, et. seq., of the Illinois Municipal Code, (65 ILCS 5/11-91-1),
provides, in part, whenever the corporate authorities in any municipality in the State of Illinois
determine that the public interest will be subserved by vacating any street or alley, or part
thereof, within their jurisdiction in any incorporated area, they may vacate that street or alley, or
part thereof, by an Ordinance; and
WHEREAS, Section 11-91-1 of the Illinois Municipal Code also provides that the Ordinance
vacating any street or alley, or part thereof, shall be passed by the affirmative vote of at least
three-fourths of the aldermen, trustees or commissioners then holding office; and
WHEREAS, the corporate authorities of the City of Canton, Fulton County, Illinois have
determined that the public interest shall be subserved by vacating Mercantile Court as it was
platted but not actually constructed as the project is cost prohibitive.
WHEREAS, the corporate authorities of the City of Canton, Fulton County, Illinois have
determined that based on the foregoing, the public interest shall be subserved by vacating
Mercantile Court, in the City of Canton, Fulton County, Illinois, said street more fully described
in the attached legal description, attached hereto and incorporated herein as Exhibit A and
referenced on the plat prepared by Cloninger Land Surveying, attached hereto and incorporated
herein as Exhibit B; and
WHEREAS, the above-described street and the properties contiguous to said street are wholly
within the jurisdiction and corporate limits of the City of Canton, Illinois; and

NOW, THEREFORE, BE IT ORDAINED by the Mayor and the City Council of the City of
Canton, Fulton County, Illinois as follows:
1. That the City Council of the City of Canton, Fulton County, Illinois hereby finds the
foregoing recitals to be fact.
2. That the street, commonly known as Mercantile Court, in the City of Canton, Fulton County,
Illinois, and more fully-described on Exhibit A and depicted on Exhibit B is hereby vacated.
3. That the City Clerk of the City of Canton, Illinois is hereby ordered and directed to have a
certified copy of this Ordinance recorded in the office of the Recorder of Deeds of Fulton
County, Illinois immediately upon passage and approval of this Ordinance.
4. That this Ordinance shall be in full force and effect immediately upon its passage by the
affirmative vote of at least three-fourths of the aldermen then holding office in the City of
Canton, Fulton County, Illinois and the approval of the Mayor thereof.
PASSED by the affirmative vote ofthree-fourths of the aldermen then holding office in the City
of Canton, Fulton County, Illinois at a regular meeting this ~r~ day of

AYES: Aldermen. Schenck, Berardi, Sarff, 41est, Nidiffer, Ihnes, Strandberg,
Lewis.
NAYS: None.

DESCRIPTION OF NORTH PART OF MERCANTILE COURT
A part of the Southeast Quarter of Section 29, Township 7 North, Range 4 East
of the Fourth Principal Meridian, Fulton County, Illinois:
Beginning at the southeast corner of Lot 12 in the Subdivision of Enterprise
Industrial District as described in Book 1009, Page 258 in the Fulton County
Recorder's Office; thence South 00 degrees 48 minutes 14 seconds West, 30.00
feet (bearings refer to said Subdivision of Enterprise Industrial District plat) along
the west line of Enterprise Drive to the centerline of Mercantile Court; thence
South 89 degrees 45 minutes 28 seconds West, 310.00 feet along said
centerline to the center of the cul-de-sac at the unrest end of said Mercantile
Court; thence South 73 degrees 50 minutes 32 seconds West, 60.00 feet to the
east end of the south line of Lot 13 in said Subdivision of Enterprise Industrial
District; thence along the westerly and northerly side of said cul-de-sac 173.75
feet along a curve to the right, whose radius is 60.00 feet, the chord of said curve
bears North 66 degrees 48 minutes 00 seconds East, 119.09 feet; thence North
89 degrees 45 minutes 28 seconds East, 258.58 feet along the north side of said
Mercantile Court to the Point of Beginning, containing 0.315 acres more or less.
DESCRIPTION OF SOUTH PART OF MERCANTILE COURT
A part of the Southeast Quarter of Section 29, Township 7 North, Range 4 East
of the Fourth Principal Meridian, Fulton County, Illinois:
Beginning at the Northeast corner of Lot 15 in the Subdivision of Enterprise
Industrial District as described in Book 1009, Page 258 in the Fulton County
Recorder's Office; thence South 89 degrees 45 minutes 28 seconds West,
257.49 feet (bearings refer to said Subdivision of Enterprise Industrial District
plat) along the south line of Mercantile Court; thence along the southerly side of
the cul-de-sac ore the west end of said Mercantile Court 140.42 feet along a
curve to the right, whose radius is 60.00 feet, the chord of said curve bears North
83 degrees 12 minutes 10 seconds West, 110.50 feet to the east end of the north
line of Lot 14 in said Subdivision of Enterprise Industrial District; thence North 73
degrees 50 minutes 32 seconds East, 60.00 feet to the center of said cul-de-sac;
thence North 89 degrees 45 minutes 28 seconds East, 310.00 feet along the
centerline of said Mercantile Court to the west line of Enterprise Drive; thence
South 00 degrees 48 minutes 14 seconds West, 30.00 feet along said west line
to the Point of Beginning, containing 0.292 acres more or less.
