HomeMy WebLinkAboutOrdinance #2092 ORDINANCE NO 2092 AN ORDINANCE AMENDING SECTION 9-5-17 (TRUCK PARKING AND REFRIGERATED TRUCK CONTROL) OF THE CANTON, ILLINOIS MUNICIPAL CODE WHEREAS, the City of Canton has general regulations governing parking of trucks and refrigerated trucks, as well as general parking requirements on Enterprise Drive; and WHEREAS, the current ordinances generally prohibit any parking on Enterprise Drive; and WHEREAS, late night deliveries are commonly made to this location; and WHEREAS, federal law generally requires drivers to have a rest period, drivers typically make deliveries, rest overnight and leave early the next morning; and WHEREAS, there is no practical place for drivers to park their vehicle after they deliver a load and before departing with a new load nor is there a suitable place within a reasonable distance for drivers to park their vehicles on an overnight basis; and WHEREAS, designating a temporary loading zone between 11:00 p.m. and 7:00 a.m. along seventy five (75') feet of Enterprise Drive will not interfere or impede traffic; and WHEREAS, the Public Safety Committee has determined that it is necessary and in the best interest of the citizens of Canton, Illinois, amend Section 9-5-17 of the Canton Municipal Code to create a temporary loading zone on Enterprise Drive in the City of Canton, Illinois; and WHEREAS, the City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. The City reaffirms Ordinance No. 2083 as to no parking on Enterprise Drive, except as to the location designated as a Temporary Loading Zone in Section 9-5-17 of the Code; and 2. That Section 9-5-17 of the Canton Municipal Code is hereby amended as follows: 9-5-17: TRUCK PARKING AND REFRIGERATED TRUCK CONTROL; TEMPORARY LOADING ZONES: (A) Definitions: The following terms shall have the meanings given them: BUS: A motor vehicle, other than a commuter van, designed for carrying more than ten (10)persons. LARGER TRUCK: Any motor truck with a D license or larger. REFRIGERATED TRUCK: A truck or trailer or other movable container which is refrigerated by means of an internal combustion engine as its source of power. TRUCK TRACTOR: Any motor truck designed to pull a semitrailer. (B)Truck Parking: No person shall park, leave or store any larger truck, truck tractor, bus or refrigerated truck on the streets of the city except under the following circumstances: 1. When a bona fide delivery is being made for the reasonable time required. 2. Where the vehicle is mechanically disabled for the reasonable time required to remove same for repair. 3. When the vehicle is parked in a temporarv loading zone. (C)Refrigerated Truck Control: No person may park, leave or store any refrigerated truck while its refrigeration engine is operating or any truck or truck tractor with its engine running except when parked in an area zoned for such purpose and more than five hundred feet (500') from any zoned residential area or when parked in a temporary loadin z~ (D)Temporary Loading Zones: Persons mav park, leave or store anv larger truck, truck tractor or refrigerated truck within areas designated by the City Council as a Temporary Loading Zone, said area not to exceed seventy five feet (75' along the curb, marked and si nage posted as such, and subiect to the followin~ 1. No truck, truck tractor or refrigerated truck ma~~arked within a Temparary Loading Zone before 11:00 p.m. and after 7:00 a.m. 2. Dropping, removing or leaving a moveable container or semitrailer is specifically prohibited within the Temporary Loadin Zone. (E) Penalty: Any person violating any of the provisions of this section shall be fined not less than seventy five dollars ($75.00) nor more than five hundred dollars ($500.00) or be incarcerated in a penal institution for a period of time not to exceed thirty (30) days, or both. Each day or portion thereof that a violation is allowed to exist shall constitute a separate offense. 3. That the City Council hereby designates the west side of Enterprise Drive, beginning at Opportunity Lane and extending south for seventy five (75') feet as a Temporary Loading Zone. 4. That this Ordinance shall be in full force and effect ten (10) days after its passage by the City Council of the City of Canton, Fulton County, Illinois, approval by the Mayor thereof, and publication as provided by law.
