HomeMy WebLinkAboutOrdinance #1714=. E ORDINANCE NO. 1714 AN ORDINANCE AMENDING THE CANTON ZONING ORDINANCE TO PROVIDE FOR A BED AND BREAKFAST IN DISTRICTS R-1 THRU R-4 AND B-1 THRU B-3. WHEREAS, the Bed and Breakfast may appropriately, under special circumstances, be located in various places within the City; and, WHEREAS, the Canton Zoning Ordinance should be amended to provide for a Bed and Breakfast in Districts, R-1, R-2, R-3, R-4, B-l, B-2, and B-3; and, WHEREAS, the State of Illinois has adopted the Bed and Breakfast Act which provides that this act shall be known and may be cited as the "Bed and Breakfast Act". WHEREAS, said statue authorizes a municipality to provide for the regulation, safe operation, licensing and inspection of bed and breakfast establishments. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS: 1. The Canton Zoning code is amended as follows: a. Section 10-1-2 (Definitions) is amended to add the following definition: "Bed and breakfast establishment" shall mean an operator-occupied residence providing accommodations for a charge to the public with no more than 5 guest rooms for rent, in operation for more than 10 nights in a 12 month period. Breakfast may be provided to the guests only. Bed and breakfast establishments shall not include motels, hotels, boarding houses, or food service establishments pursuant to State Statues. b. Section 10-1-2 (Definitions) is amended to add the following defuution: "Bed and Breakfast Operator" shall mean the owner of the bed and breakfast establishment, or the owner's agent, who is required by this Act to reside in the bed and breakfast establishment, or on contiguous property. ti c. Section 10-4-3 (R-1), 10-5-3 (R-2), 10-6-3 (R-3), 10-7-3 (R- 4), 10-8-3 (B-1), 10-9-3 (B-2), 10-10-3 (B-3) (Special Use Exceptions) is amended to provide for a Bed and Breakfast to be a special use permit. d. Section 10-4-3 (R-1), 10-5-3 (R-2), 10-6-3 (R-3), 10-7-3 (R- 4), 10-8-3 (B-1), 10-9-3 (B-2), 10-10-3 (B-3) (Special Use Exceptions) Signs when located on the same lot pertaining to the use of that particular building or buildings; provided, that they will not overhang any public right of way, shall not be illuminated, and shall not exceed twelve (12) square feet in area. 2. That this ordinance shall be in full force and effect after its passage by the City Council of the City of Canton, Fulton County, Illinois, approved by the Mayor thereof and publication as provided by law. MAIN STREET CANTON, IL 61520 March 14, 2002 Ms. Alice Brown 1060 North Main Canton, IL 61520 RE: Parking for Proposed Bed & Breakfast MSI File #234-02001 Dear Ms. Brown: Having looked at your site and investigated City Ordinances regarding parking, we offer the following opinions: - It is our understanding that your property is zoned R-2 with a special use permit for a Bed & Breakfast. We feel that the beginning of your proposed parking area should be located at least three (3) feet back from the property line in accordance with City Ordinance 10-14-1(E). For your information, a copy of the local "Bidwell" lot map is attached which shows a 40 foot right-of-way width for Longwood Drive. This, of course, is not a guarantee of actual right-of-way width or location which can only be established by a Professional Land Surveyor. - As we previously discussed, it appears parking could possibly fit between the two large trees adjacent to Longwood Drive. Parking spaces are required to be 10 feet wide by 20 feet long. Due to the nature of ingress and egress to Longwood Drive, we believe these spaces should be stripped at 90 degrees to the street. In other words, slant parking is not recommended in this situation. City Ordinance 10-14-2(20) requires one parking space per guest bedroom. We further advise you that in accordance with State and Federal "ADA" requirements a minimum of one handicap space be included (see attached detail). - Parking area is required to be paved in accordance with City Ordinance 10-14-1 (E). Ms. Alice Brown March 14, 2002 - Your contractor, Spoon River Blacktop, is proposing to place a 4-inch drain pipe in the north gutter of Longwood Drive: this is unacceptable. You or the contractor will need to obtain a curb cut and driveway permit from City Zoning Officer Clark Wilson or Superintendent of Streets Clif O'Brien. The Longwood Drive curb will need to be depressed by either sawcutting or completely removing and replacing the curb and gutter to meet the City Standard. In like manner, the driveway approach to the parking area must be constructed of concrete materials meeting the intent of the City Standard. It is expected that the Standard will be followed as to materials, grades, edge of approach treatment, etc., even though the width of the approach may be wider than allowed by the Standard. The permit fee is $5.00 and includes a copy of the Standard Detail for the contractor's information. Should you have any other questions regarding this matter, please feel free to call us.
