HomeMy WebLinkAboutOrdinance #2082 ORDINANCE NO 2082 AN ORDINANCE AMENDING THE RULES AND REGULATIONS OF THE CAMPGROUND AT CANTON LAKE AS SET FORTH IN SECTION 8-11-7-5 OF THE CANTON MUNICIPAL CODE WHEREAS, on January 25, 2011, the Canton City County adopted Ordinance No. 2025 amending Chapter 11 of Title 8 in regards to Canton Lake; and WHEREAS, said Ordinance allowed boating between sunset and sunrise as long as the boat or watercraft was equipped with lights; and WHEREAS, Section 8-11-7-5(A)(9) of the rules and regulations of the campground contains a boating restriction between one hour after sundown and sunrise; and WHEREAS, the City has determined that boating regulations need to be consistent between campground patrons and all other users of the lake; and WHEREAS, the Lakes, Buildings and Grounds Committee has determined that it is necessary and in the best interests of the citizens of Canton, Illinois to amend Section 8-11-7-5(A)(9) of the Canton Municipal Code to allow boating between sunset and sunrise as long as the boat or watercraft is equipped with lights; and WHEREAS, the City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the foregoing recitals of fact are found to be true. 2. That Section 8-11-7-5(A)(2)(a) of the Canton Municipal Code shall hereby be amended to read as follows: 8-11-7-5: RULES AND REGULATIONS, PUBLIC CAMPGROUNDS: The following rules and regulations governing camping at the public campgrounds at Lake Canton be, and the same hereby are adopted by the city council and the said rules and regulations shall have the same force and effect as ordinances validly enacted: (Ord. 1582, 5-19-1998) (A) Lake Canton Campground Rules: l. Camping shall be in designated areas only. 2. Camping fees, payable in advance, shall be: (Ord. 1768, 9-16-2003) (a) (1) For residents of the city of Canton: eight dollars ($8.00) per night for sites with no electric, nine dollars ($9.00) per night for tent sites using electric and ten dollars ($10.00) per night for camper sites using electric; and (2) For nonresidents: twelve dollars ($12.00) per night for sites with no electric, thirteen dollars fifty cents ($13.50) per night for tent sites using electric and fifteen dollars ($15.00) per night for camper sites using electric. For purposes of this subsection, "resident" is defined as all persons whose principal residence is within the corporate limits of the city of Canton; or, who have lake lot leases and who are current on lease payments and who are otherwise in full compliance with their lease provisions. The address as set forth on the applicant's driver's license shall be prima facie proof of residence. (Ord. 1999, 4-6-2010) (b) Persons who pay for a week (7 days) would be charged for six (6) days. (c) Persons who pay for a month would be charged for twenty five (25) days. (d) Persons who pay for the season (6 months) would receive thirty (30) days without additional charge. (Ord. 1728, 5-7-2002) 3. Checkout time is one o'clock (1:00) P.M. 4. All trailers must be a minimum of twenty five feet (25') apart. 5. No loud, disturbing or excess noise is permitted between ten o'clock (10:00) P.M. and eight o'clock (8:00) A.M. 6. Overnight guests must adhere to all rules; campground closes at eleven o'clock (11:00) P.M. for guests. 7. No outside refrigerators are permitted. 8. All pets must be confined on a leash. A"no wak~" period is in effect between sunset and sunrise for all boats and w~tercrai~.: 10. All boats shall be launched and retrieved at the boat dock only. 11. No rubber rafts shall be launched or retrieved at the campground area or at the beach area. 12. No swimming is permitted except as otherwise provided in this code. ~ 13. All persons are to stay out of boats tied up at the campground area. 14. Children are to be supervised on the dock. 15. All fish heads, entrails and other refuse and garbage shall be rolled in paper, placed in a double plastic bag, sealed and then deposited in a designated trash barrel, or dumpster. 16. Fishing shall be by pole and line only. No trotlines are permitted. 17. No public picnics axe allowed in campgrounds, campers only. 18. No fireworks are allowed in camping areas; anyone doing so will be asked to vacate immediately. 19. Campsites are limited to one picnic table per site. 20. There will be a twenty five dollar ($25.00) check charge for any returned checks, and camper will be required to pay in cash thereafter. (Ord. 1582, 5-19-1998) Any person who shall violate this section or any provision thereof shall be ordered from the campground and shall forfeit his campground privileges for the remainder of the permit period, without refund of the camping fee. If any such person fails or refuses to leave the campground, he shall be subject to a fine of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each such failure or refusal.
