HomeMy WebLinkAboutOrdinance #2074 ORDINANCE NO. 2074 AN ORDINANCE GRANTING A HOME OCCUPATION PERMIT TO ERIC L. PARSANO AT 65 '/z NORTH SYCAMORE TERRACE, CANTON, ILLINOIS 61520. WHEREAS, A Petition for Special Use Permit/Home Occupation Permit signed by Eric L. Parsano, the owner of the real property hereinafter described, was filed before the Planning and Zoning Commission of the City of Canton, Illinois, requesting that a Home Occupation Permit be granted to him for the purpose of selling firearms and accessories under the guidelines of the United States Bureau of Alcohol, Tobacco, Firearms and Explosives; and WHEREAS, the real property which is the subject of this Petition is located at 65 '/z North Sycamore Terrace, Canton, Illinois and is legally described as follows: A part of lots 11 and 12, both in a Re-subdivision of Lots 9, 10, 11 and 12 in Ell- Van Park Addition to the City of Canton, Illinois, per Book 608, page 419 at the Fulton County Recorder's Office, also a part of the Northwest Quarter of the Northeast Quarter of Section 27, Township 7 North, Range 4 East of the Fourth Principal Meridian, both in Fulton County, Illinois, described as follows: Commencing at a set 5/8" x 24" rod, said rod bearing on the most Northerly, West line of said Lot 12 as the point of beginning of the tract to be described; from said point of beginning, thence continuing along West line bearing North 00 degrees 10 minutes 00 seconds West, a distance of 48.21 feet to a found 5/8" rod, said rod bearing the Northwest corner of said Lot 12; thence bearing North 00 degrees 45 minutes 40 seconds West, a distance of 84.49 feet to a set 5/8" x 24" rod; thence bearing North 89 degrees 03 minutes 18 seconds East, a distance of 118.20 feet to a found 5/8" rod; thence bearing South O1 degrees 04 minutes 18 seconds East, a distance of 84.25 feet to a found 5/8" rod, said rod bearing the Northeast corner of said Lot 11; thence along the East line of said Lot 11 bearing South 02 degrees 47 minutes 29 seconds East, a distance of 10.21 feet to a set 5/8" x 24" rod; thence leaving said East line bearing South 71 degrees 19 minutes 42 seconds West, a distance of 125.60 feet to the point of beginning, containing 0.309 acres, more or less. PIN:09-08-27-201-003 COMMON ADDRESS: 65 '/Z North Sycamore Terrace, Canton, Illinois 61520; and WHEREAS, Eric L. Parsano is the owner of record of the real property located at 65 '/z North Sycamore Terrace, Canton, Illinois 61520, and there are no other owners of record; and WHEREAS, said real property is wholly situated within the corporate limits of the City of Canton, Illinois and is presently zoned R-2, Single Family Residential District; and WHEREAS, all petitions, documents and other necessary legal requirements are in full compliance with the statutes of the State of Illinois and ordinances of the City of Canton, Illinois 1 and proper notice of the filing of the Petition for Special Use Permit/Home Occupation Permit was given as provided by law; and WHEREAS, a public hearing was held before the Planning and Zoning Commission of the City of Canton, Illinois on November 14, 2011, pursuant to proper notice published in The Daily Ledger, a secular newspaper having a general circulation in the City of Canton, County of Fulton and State of Illinois; and WHEREAS, on February 13, 2012, the Planning and Zoning Commission of the City of Canton, Illinois did not recommend to the City Council of the City of Canton, Illinois that a Home Occupation Permit be granted to Eric L. Parsano for the purpose of selling firearms and accessories under the guidelines of the United States Bureau of Alcohol, Tobacco, Firearms and Explosives; and WHEREAS, it is in the best interest of the City of Canton, Illinois that said Home Occupation Permit be granted. NOW, THEREFORE, be it ordained by the City Council of the City of Canton, Fulton County, Illinois as follows: 1. That the City Council finds as facts the recitals hereinabove set forth. 2. That a Home Occupation Permit be, and the same is hereby issued to Eric L. Parsano shall operate and conduct his home occupation in conformity with all of the conditions and guidelines set forth in Section 10-15.1-5 of the Canton Municipal Code. 4. That this Home Occupation Permit shall be personal to Eric L. Parsano and shall apply only at the above stated address. The Home Occupation Permit granted herein is non- transferable and non-assignable by Eric L. Parsano and shall remain in full force and effect unless revoked pursuant to Section 10-15.1-10 of the Canton Municipal Code. The Home Occupation Permit granted herein shall also be deemed to be automatically revoked upon the earliest of the following: the death of Eric L. Parsano; if Eric L. Parsano moves from the premises where the Permit was granted; or if Eric L. Parsano otherwise ceases to engage in the home occupation. 5. That this Home Occupation Permit shall be valid for a period of twenty-four (24) months from and including the date of its issuance pursuant to Section 10-15.1-6 of the Canton Municipal Code. The Home Occupation Permit may be renewed for a like period of time upon the reapplication of Eric L. Parsano. 6. That the records of the City of Canton, Illinois, appropriate documents, maps and related regulations be, and the same are hereby amended to reflect the foregoing Home Occupation Permit. 7. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof.
