HomeMy WebLinkAboutOrdinance #1692ORDINANCE NO. 1692 AN ORDINANCE ANNEXING AND RE-ZONING CERTAIN TERRITORY TO THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, a Petition for Annexation and Re-Zoning, signed by the owners of record of the territory hereinafter described, was filed before the Planning and Zoning Commission of the City of Canton, Illinois, requesting that said territory be annexed to the City of Canton and re-zoned to an R-2 (Single Family Residential District) zoning classification; and WHEREAS, the territory which is the subject of this Petition is legally described on Exhibit A, which is attached hereto and made a part of this Ordinance by reference, and is located at 1271 West Locust Street, in the City of Canton, Fulton County, Illinois; and WHEREAS, Jonathon W. Snider and Kathleen J. Snider are the owners of record of the territory to be annexed and re-zoned and there are no other owners of record and there are no electors residing within the said territory to be annexed and re-zoned other than Jonathon W. Snider and Kathleen J. Snider; and WHEREAS, the territory to be annexed and re-zoned is not within the corporate limits of any municipality, but is contiguous to the City of Canton, Illinois; and WHEREAS, the territory to be annexed and re-zoned is part of the Copperas Creek Fire Protection District; and WHEREAS, proper notice of the Petition for Annexation and Re- zoning has been given to the trustees of the Copperas Creek Community Fire Protection District as provided by law and an affidavit that service of notice has been made as provided by law has been filed with the Fulton County Recorder of Deeds; and -1- WHEREAS, all petitions, documents and other necessary legal requirements are in full compliance with the statutes of the State of Illinois and the ordinances of the City of Canton, Illinois, and proper notice of the filing of the Petition for Annexation and Re- Zoning was given as provided by law; and WHEREAS, a public hearing was held before the Planning and Zoning Commission of the City of Canton, Illinois on March 12, 2001, pursuant to proper notice published in the Canton Daily Ledger, a secular newspaper having a general circulation in the City of Canton, County of Fulton and State of Illinois; and WHEREAS, on March 12, 2001, the Planning and Zoning Commission of the City of Canton, Illinois recommended to the City Council of the City of Canton, Illinois that the territory described on Exhibit A be annexed to the City of Canton, Illinois in a zoning classification of R-2 (Single Family Residential District), pursuant to the provisions of 65 ILLS 5/7-1-8 of the Illinois Municipal Code; and WHEREAS, the territory to be annexed and re-zoned has been used for many years as a single family residence, is well suited for continued use as a single family residence and should be annexed to the City of Canton, Illinois in an R-2 (Single Family Residential District) zoning classification; and WHEREAS, the highest and best use of the territory to be annexed and re-zoned is its present use, i.e., single family residential purposes; and WHEREAS, it is in the best interest of the City of Canton, Illinois that said territory be annexed to the City of Canton, Illinois in an R-2 (Single Family Residential District) zoning classification. -2- NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois, as follows: 1. That the City Council finds as facts the recitals hereinabove set forth. 2. That the territory described on Exhibit A, which is attached hereto and made a part of this Ordinance by reference, be and the same is annexed to the City of Canton, Illinois. 3. That the territory described on Exhibit A shall be annexed to the City of Canton, Illinois in an R-2 (Single Family Residential District) zoning classification. 4. That the Zoning Administrator of the City of Canton, Illinois is hereby directed to make the appropriate changes to the zoning maps of the City of Canton to reflect this annexation and re-zoning. 5. That Jonathon W. Snider and Kathleen J. Snider are hereby directed to record with the Recorder of Deeds of Fulton County, Illinois and to file with the County Clerk of Fulton County, Illinois a certified copy of this Ordinance together with an accurate map of the territory annexed. 4. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton, Illinois, and approval by the Mayor thereof.
