HomeMy WebLinkAboutOrdinance #1689i - ORDINANCE NO. 1689 AN ORDINANCE TO AMEND CERTAIN PROVISIONS OF THE CANTON CITY CODE WHEREAS, the City of Canton, Fulton County, Illinois, anon-home rule municipality, has applied for an Illinois EPA loan to improve its water system and as a result, certain matters have been noted by the agency which are to be revised in order to allow the loan to be processed; and, WHEREAS, the City wishes to modify or amend its code in order to satisfy the requirement of the EPA, and accordingly Section 8-10-5 (~ of the City Code should be amended to provide for annual review of water rates as is currently provided for sewer rates in Section 8-10-5 (I) of the Code, and Section 8-10-26 should be renumbered as 8- 10-27, and further a new Section 8-10-26 should be added to provide for appeals arising from disagreements over methods used or computations made before any penalty could apply. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. Section 8-10-5(~ of the Canton City Code is amended by adding the words "following annual review" after the words "by City staff with prior council approval" in the first sentence. 2. Section 8-10-26 shall be renumbered as 8-10-27: PENALTY) 3. Anew section shall be added as Section 8-10-26 to the Canton City Code as follows: "APPEALS. Any person who disagrees with the methods used or computations made shall be entitled to a written summary of same within 10 days of receipt of a written request for same. Any disagreement over the methods used or in the computations thereof shall be either affirmed or remedied within 10 days by the Superintendent of the Water Department of the City after a formal written appeal detailing the alleged discrepancies." 4. That this ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, approval by the Mayor thereof and publication in pamphlet form. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 20th day of March 2001, upon a roll call vote as follows: AYES: Aldermen, May, Shores, Meade, Nidiffer, Phillips, Sarff, Hartford, Molleck, NAYS: None, ABSENT: None .
