AN ORDINANCE IlVITIATING THE SUBA~II.SSION OF A PUBLIC QUESTION TO
AUTHORIZE THE ~IDTENTI~Ai.OAND SMALL CO
'MMERC R.ETAIL CUSTOMERS OF
ELECTRICITY T
W~iEREAS, as of August 12, 2011, Section 1-92 of the Ill'vnois Power Agency Act, 20
ILCS 3855/1-92 {the "Act"), permits the corporate authorities of the Ciry, if authorized by
referendum, to adopt an ord.inance creating a prograrn to allow the City to solicit bids and enter
into service agreements for the sale and pwrchase of elect~icity and related services and
equipment to residential and small commercial customers in tb:e City who do not choose to opt-
aut {the "Program"); and
WHEREAS, pursuant to the requirements of the Act, the corporate authorities of the
City of Canton hereby desire to place on the March 20, 2012 ballot a public question to be
considered by the voters in the City regarding an authorization of the City to pursue the
implem8ntation of the Program.
NOW, THEFtEFORE, BE IT ORDAINED BY THE MAYUR AND CITY COUNCIL 4F
THE CTTY OF CAN'TON, FULTON COUNTI', ILLINOIS, as foliows:
1. RECTTALS: The foregaing recitals are incorporated as if fully set forth in this
Ordinance.
2. PUBLIC QUESTION 4N AGGREGATION OF ELECTRICITY: A public guestion
shall be submitted to the voters of the City of Canton, Fulton County, Illinois, at the
March 20, 2012 general primary electian (or at the n~xt available electian permitted bY
the general election law), in substantially the same as fallows:

3. FILING: The City Clerk is hereby authorized and directed to file ttus authorizing
Ordinance and other related matters with the appropriate election officials in accordance

4. EFFECTTVE DATE: This Ordinance shall become effective follows its passage and
approval in the manner provided by law.
