An Ordinance granting a Special Use Permit for the operation of a daycare
center at 3100 North Main Street, Canton, IL.
WHEREAS, it appears to the City Council of the City of Canton, Fulton County,
Illinois, that the territory hereinafter described is located within the corporate limits of
the City of Canton, Fulton County, Illinois; and
WHEREAS, a Petition was filed by Gary E. Barnhart, not individually, but as Land
Trustee of the BDW Land Trust No. 530, requesting a Special Use Permit for the use of
the property hereinafter described as a daycare facility/Headstart school; and
WHEREAS, Notice of a Petition for a Special Use Permit in a B-2 Zoning
Configuration was published in the Canton Daily Ledger, a newspaper of regular
circulation in the City of Canton, County of Fulton and State of Illinois, all in accordance
with the Statutes of the State of Illinois and the Ordinances of the City of Canton so
made and provided; and
WHEREAS, no objectors appeared at said hearing and said Planning & Zoning
Commission did thereupon make favorable finds of fact and did recommend to the City
Council of the City of Canton, Illinois, that said Special Use Permit be issued for the use
of the property hereinafter described as a daycare facility/Headstart school.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS:

1. That the City Council of the City of Canton, Fulton County, Illinois, hereby
finds the foregoing recitals to be fact.
2. That a Special Use Permit for the use of the property at 3100 North Main
St., Canton, IL 61520 and described herein on the attached Exhibit A, shall be and the
same is hereby issued to Gary E. Barnhart, not individually, but as Land Trustee of BDW
Land Trust No. 530.
3. That the appropriate maps, plats and related documents of the City of
Canton shall be and the same are hereby amended to reflect the foregoing Special Use
Permit granted herein.
PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a
regular meeting of said City Council this 4th day of October, 2011, upon a roll call vote
of 7 AYES and 0 NAYS, with 1 Aldermen absent.

outside playground area as depicted on Exhibit B and located on the
following described real estate:

Part of the Southeast Quarter of Section 10, Township 7 North, Range 4
East of the Fourth Principal Meridian, Fulton County, Illinois, more
particularly described as follows:
Beginning at an iron pin on the Westerly right-of-way line of Illinois State
Route 78 and being West 1460.45 feet and North 3 degrees 43 minutes
48 seconds East 929.43 feet from an iron pin at the Southeast corner of
said Southeast Quarter; thence North 86 degrees li minutes 58 seconds
