HomeMy WebLinkAboutOrdinance #1736,r, ORDINANCE NO. 1736 AN ORDINANCE AMENDING AND RESTATING 5-8-1 THRU 5-8-4 OF TITLE 5, OF THE CANTON MUNICIPAL CODE RELATING TO BURNING REGULATIONS. WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and in the best interest of the City of Canton to amend and restate 5-8-lthru 5-8-4 of Title 5 of the Canton Municipal Code; and, WHEREAS, the Canton City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the foregoing recitals are hereby found to be fact. 2. That accordingly, Titles 5-8-1 thru 5-8-4 of the Canton Municipal Code is hereby amended to read as follows: 5-8-1: BURNING TRASH, PAPERS, RUBBISH, WIRE OR GARBAGE: a. Outdoor Burning Prohibited: No person shall burn any processed wood, trash, paper, rubbish, wire or garbage out of doors anywhere in the City. b. Other Burning Prohibited: No person shall burn any trash, paper, rubbish, wire, or garbage indoors in the City except in an incinerator complying with all applicable laws, ordinances, and EPA regulations. c. Heating and Cooking Stoves: Nothing in this Chapter shall be deemed to prohibit the use of wood in stoves used for cooking, the use of wood in fireplaces for decorative fire or the use of wood in fireplaces or stoves designed for heating. 5-8-2 BURNING OF YARD CLIPPINGS: Open burning of leaves, grass cuttings, shrubbery cuttings, tree limbs, and other materials accumulated as the result of the care of lawns, shrubbery, vines and trees (hereinafter referred to as landscape waste). The open burning of landscape waste is prohibited within the City limits except as follows: a. The Open Burning of landscape waste shall be permitted only on Mondays, Wednesdays, Fridays, and Saturdays between the hours of nine o'clock (9:00) a.m. and sunset b. The Open Burning of landscape waste shall be permitted on private property, with the consent of the owner or person in charge of the property. c. The Open Burning of landscape waste is not permitted on lanes, parking areas, alleys and all paved areas. The smoke emitted from such burning shall not inhibit the flow of smooth and safe vehicular or pedestrian traffic passage. d. No person shall burn any landscape waste unless such fire ~at least twenty feet (20') from any structure. e. Any fire resulting from the open burning of landscape waste shall be constantly attended by a competent person until such fire is extinguished. +^s ' f. The Fire Chief or his designee shall prohibit any open burning of landscape waste when the atmospheric conditions or other conditions at the location of the fire constitute a hazard, which include environmental, health or safety hazards. 5-8-3: RECREATIONAL BURNING: a. The Recreational Burning shall be permitted on private property, with the consent of the owner or person in charge of the property. b. The Recreational Burning is not permitted on lanes, parking azeas, alleys and all paved areas. The smoke emitted from such burning shall not inhibit the flow of smooth and safe vehicular or pedestrian traffic passage. c. No person shall have a recreational burning unless such fire is at least twenty feet (20') from any structure. d. That Recreational Burning shall be permitted only if constantly attended by a competent person until such fire is extinguished. e. That Recreational Burning may consist of only natural wood, limbs and logs. f. The Fire Chief or his designee shall prohibit any recreational burning when the atmospheric conditions or other conditions at the location of the fire constitute a hazard. g. That if the Canton Fire Department deems the burning unsafe or an infringement on others said burning shall be extinguished by a competent person or the Canton Fire Department. 5-8-4: PENALTY: Any person violating any provision of this Chapter shall be fined not less than severity five dollars ($75.00) no more than five hundred dollazs ($500.00) for each offense, and a sepazate offense shall be deemed committed on each day during or on which a violation occurs or continues. 3. That this Ordinance shall become effective immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, and approval by the Mayor thereof.
