HomeMy WebLinkAboutOrdinance #1735ORDINANCE NO. 1735 AN ORDINANCE AMENDING ORDINANCE NUMBER 959 ENTITLED, "AN ORDINANCE INITIATING AND COOPERATIVELY DESIGNATING AN ENTERPRISE ZONE". WHEREAS, on December 27, 1982, the City Council of the City of Canton, Fulton County, Illinois passed Ordinance No. 959 entitled, "An Ordinance Initiating and Cooperatively Designating an Enterprise Zone", providing metes and bounds description for the City of Canton/Fulton County Enterprise Zone; and, WHEREAS, the City of Canton has determined that it is necessary and in the best interest of the City of Canton and economic development in the Canton area to expand the City of Canton/Fulton County Enterprise Zone; and, WHEREAS, a public heazing was held at the meeting of the Fulton County Boazd on July 9, 2002, at the Fulton County Courthouse for the purpose of the expansion of the City of Canton/Fulton County Enterprise Zone where pertinent information was presented. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the City Council of the City of Canton hereby approves, subject to concurrence of the Illinois Department of Commerce and Community Affairs, the expansion of the City of CantonlFulton County Enterprise Zone to include property identified in Exhibit "A" hereby incorporated by reference. 2. That the City of Canton, subject to approval of the Illinois Department of Commerce and Community Affairs, hereby approves the new metes and bounds description for the enterprise zone as identified in Exhibit "B" hereto. 3. That the Fulton County Boazd passed a Resolution on July 9, 2002 approving the expansion of the City of Canton/Fulton County Enterprise Zone to include property identified in Exhibit "A" hereby incorporated by reference, and the new metes and bounds description for the Enterprise Zone as identified in Exhibit "B" hereto. 4. That the City of Canton will provide all local benefits and amenities in the expanded pazcel as is currently being accorded to inhabitants of the City of Canton/Fulton County Enterprise Zone. 5. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. APPROVED: Jerry Bo er, Mayor ATTEST: ~ti Nancy White City Clerk EXHIBIT A METES AND BOUNDS DESCRIPTION PROPOSED ENTERPRISE ZONE EXPANSION WHEREAS, Canton's current Enterprise Zone encompasses the former International Harvester site, among other properties, and extends south and east to the East R.O.W. line of the Burlington Northern Santa Fe Rail Road and the North R.O.W. line of Oak Street in Canton; and WHEREAS, Canton wishes to extend its Enterprise Zone to the south and east to include certain property in Buckheart Township, Fulton County Illinois where an ethanol plant is proposed to be constructed; and NOW THEREFORE, the proposed addition to Canton's Enterprise Zone consists of the following: A strip of land five (5) feet wide commencing at the intersection of the East R.O.W. line of the Burlington Northern Santa Fe Rail Road and the North R.O.W. line of Oak Street in Canton, and extending five (5) feet west into Burlington Northern Sdanta Fe R.O.W., thence continuing south along said East R.O.W. line of the Burlington Northern Santa Fe Rail Road to the Burlington Northern Santa Fe Rail Road Spur to the Central Illinois Light Company Power Station, and continuing in an easterly direction along the North R.O.W. line of said spur to and including the following described real estate: The South Half of the Northwest Quarter of Section 13, Township 6 North, Range 4 East of the Fourth Principal Meridian, Fulton County, Illinois.
