HomeMy WebLinkAboutOrdinance #2034 ORDINANCE NO. ~ 203 ~ AN ORDINANCE GRANTING A HOME OCCUPATION PERMIT TO BRAD L. SOLAND AT 1005 NORTH MAIN STREET, CANTON, ILLINOIS 61520. WHEREAS, A Petition for Special Use Permit/Home Occupation Permit signed by Brad L. Soland, the owner of the real property hereinafter described, was filed before the Planning and Zoning Commission of the City of Canton, Illinois, requesting that a Home Occupation Permit be granted to him for the purpose of selling firearms and accessories under the guidelines of the United States Bureau of Alcohol, Tobacco, Firearms and Explosives; and WHEREAS, the real property which is the subject of this Petition is located at 1005 North Main Street, Canton, Illinois and is legally described as follows: Lot 28 except 73 feet of even width off the East side thereof in Charles Winegar Subdivision of a part of the Southeast Quarter of Section 22, Township 7 North of the Base Line, Range 4 East of the Fourth Principal Meridian, according to the plat thereof recorded in Volume 635 at Page 138 in the Office of the Recorder of Deeds, Fulton County, Illinois. PIN: 09-08-22-408-006 COMMON ADDRESS: 1005 North Main Street, Canton, Illinois 61520; and WHEREAS, Brad L. Soland is the owner of record of the real property located at 1005 North Main Street, Canton, Illinois 61520 along with his wife, Brenda L. Soland, and there are no other owners of record; and WHEREAS, said real property is wholly situated within the corporate limits of the City of Canton, Illinois and is presently zoned R-2, Single Family Residential District; and WHEREAS, all petitions, documents and other necessary legal requirements are in full compliance with the statutes of the State of Illinois and ordinances of the City of Canton, Illinois and proper notice of the filing of the Petition for Special Use Permit/Home Occupation Permit was given as provided by law; and WHEREAS, a public hearing was held before the Planning and Zoning Commission of the City of Canton, Illinois on May 9, 2011, pursuant to proper notice published in The Daily Ledger, a secular newspaper having a general circulation in the City of Canton, County of Fulton and State of Illinois; and WHEREAS, on May 9, 2011, the Planning and Zoning Commission of the City of Canton, Illinois recommended to the City Council of the City of Canton, Illinois that a Home Occupation Permit be granted to Brad L. Soland for the purpose of selling firearms and accessories under the guidelines of the United States Bureau of Alcohol, Tobacco, Firearms and Explosives; and 1 WHEREAS, it is in the best interest of the City of Canton, Illinois that said Home Occupation Permit be granted. NOW, THEREFORE, be it ordained by the City Council of the City of Canton, Fulton County, Illinois as follows: 1. That the City Council finds as facts the recitals hereinabove set forth. 2. That a Home Occupation Permit be, and the same is hereby issued to Brad L. Soland for the purpose of selling firearms and accessories under the guidelines of the United States Bureau of Alcohol, Tobacco, Firearms and Explosives at 1005 North Main Street, Canton, Illinois 61520, which real property is legally described as follows: Lot 28 except 73 feet of even width off the East side thereof in Charles Winegar Subdivision of a part of the Southeast Quarter of Section 22, Township 7 North of the Base Line, Range 4 East of the Fourth Principal Meridian, according to the plat thereof recorded in Volume 635 at Page 138 in the Office of the Recorder of Deeds, Fulton County, Illinois. Soland shall operate and conduct his home occupation in conformity with all of the conditions and guidelines set forth in Section 10-15.1-5 of the Canton Municipal Code. 4. That this Home Occupation Permit shall be personal to Brad L. Soland and shall apply only at the above stated address. The Home Occupation Permit granted herein is non- transferable and non-assignable by Brad L. Soland and shall remain in full force and effect unless revoked pursuant to Section 10-15.1-10 of the Canton Municipal Code. The Home Occupation Permit granted herein shall also be deemed to be automatically revoked upon the earliest of the following: the death of Brad L. Soland; if Brad L. Soland moves from the premises where the Permit was granted; or if Brad L. Soland otherwise ceases to engage in the home occupation. 5. That this Home Occupation Permit shall be valid for a period of twenty-four (24) months from and including the date of its issuance pursuant to Section 10-15.1-6 of the Canton Municipal Code. The Home Occupation Permit may be renewed for a like period of time upon the reapplication of Brad L. Soland. 6. That the records of the City of Canton, Illinois, appropriate documents, maps and related regulations be, and the same are hereby amended to reflect the foregoing Home Occupation Permit. 2 7. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof. PASSED by a majority vote of the City Council of the City of Canton, Illinois, and APPROVED by the Mayor thereof this 7t" day of June, 201 l, upon a roll call vote as follows: AYES: Alderman Schenck, West, Pasley, Fritz, Ellis, Nelson, Pickel NAYS: Alderman Hartford ABSENT: None Approved: Kevin R.
